§ 1.04.020 Zoning Map Revisions
AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The property is the location of the Teton Vu Drive-In. In 2006, Thomas Goe rezoned the property
from Low-Density Residential 3 (LDR3) to Community Business Center (06-00047).
The Rexburg Development Code allows the Commission to
make recommendations to the City Council regarding whether
or not the property should or should not be rezoned based on the
criteria found in section §1.04.020.
II. SITE DESCRIPTION
The property is located east of N Yellowstone Hwy. There is a
single-family home to the north, a vacant lot to the east, a
commercial business to the west, and multi-family homes to the
south. Medium-Density Residential 1 (MDR1) zoned parcels are
located to the south from the requested property at the Thomson
Farms subdivision. The property is 10.84 acres.

III. ANALYSIS
If approved, the request will result in changing the
zoning at 1114 S Yellowstone from Community
Business Center (CBC) to Medium-Density Residential
1 (MDR1) for 10.84 acres.
The request would require the Commission and City
Council to review the proposal against one set of
criteria, for the request to rezone. Below, staff has
provided all the criteria listed by Ordinance No. 1200
(Development Code) that are required to be addressed,
followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The request is not in conformance with the Comprehensive Plan Map. A Comprehensive Plan
Map change will need to be approved.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
There is capacity for water and sewer. All storm water will have to be handled on site. Access
requirements will be per the Idaho Transportation Department.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services. N/A
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties. N/A
e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
In 2017, a Preliminary Planned Unit Development was approved for Thomson Farms (17-00704).
In June 2019, the Comprehensive Plan Map was changed for this parcel to Low-Moderate (19-
00351). In 2020, a Comprehensive Plan Map change was completed to match the approved zoning
for Thomson Farms (20-00076). Parcels to the east were zoned to Transitional Agriculture (TAG)
in 2020 (20-00914). In 2021, the Comprehensive Plan was amended for this parcel to
Commercial/Mixed Use (21-00057).
f. Meets the requirements of the Development Code.
The request meets the requirements of the Development Code.
IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the rezone of 1114 N
Yellowstone Hwy from Community Business Center (CBC) to Medium-Density Residential 1 (MDR1)
with the following condition, if the Commission finds that the proposed request is compatible with the
surrounding area or in the best interest of the neighborhood and the community.
1. A Comprehensive Plan Map change will be needed to change the designation to LDR1 to MDR1
to support this zone change.
