NOTICE OF PUBLIC HEARING
FOR AN ANNEXATION AND REZONE IN THE REXBURG IMPACT AREA
IN THE CITY OF REXBURG
Public Hearing: February 16, 2022 at 7:00 pm to be held before the Rexburg City Council, in the
City Council Chambers of the City Building at 35 North 1st East, Rexburg, Idaho, to Annex
properties in the Impact Area at approximately 1022 and 1040 W Main St, Parcels MHMH03410,
RP06N39E244821, RP06N39E246001, RP06N39E244825, and RP06N39E244803 in the
Community Business Center (CBC) zone into the City of Rexburg for file (#21 00973).
The proposed zone change at approximately 1022 and 1040 W Main St, Parcels MHMH03410,
RP06N39E244821, RP06N39E244825, and RP06N39E244803, will be from Community Business
Center (CBC) to Mixed Use (MU) zone.
Legal Description of Property:
Annexation only D.S.H. Property Parcel RP06N39E246001:
Commencing at the West Quarter corner of Section 24, Township 6 North, Range 39 East, Boise
Meridian, Madison County, Idaho, and running thence South 0°09’30” East a distance of 250.00 feet
along the section line to the True Point of Beginning; thence South 0°09'30" East a distance of 5.00
feet along the section line; thence North 89°47'33" East a distance of 1006.50 feet along a vinyl
fence; thence North 0°09'30" West a distance of 2.54 feet; thence South 89°55‘58” West a distance
of 1006.50 feet to the point of beginning. Less county road right-of-way that lies on the West side of
the parcel.

Parcel 1:
A parcel of land being on the Northerly side of the centerline of State Highway No. 33. Beginning at
a point on the South line of Section 24, Township 6 North, Range 39 East, Boise Meridian, Madison
County, Idaho, which point is approximately 1046.50 feet East from the Southwest corner of
Section 24, and running thence East 108 feet; thence North 403 feet; thence West 108 feet; thence
South 403 feet to the point of beginning.
Parcel 2:
All that portion of the SW 1/4 of Section 24, Township 6 North, Range 39 East, Boise Meridian,
Madison County, Idaho, lying West of US Highway Nos. 191 and 20.
Less and Excepting:
The West 61 rods of the SW 1/4 of Section 24, Township 6 North, Range 39 East, Boise Meridian,
Madison County, Idaho.
Also Less and Excepting:
A parcel of land being on the Northerly side of the centerline of State Highway No. 33. Beginning at
a point on the South line of Section 24, Township 6 North, Range 39 East, Boise Meridian, Madison
County, Idaho, which point is approximately 1006.5 feet East from the Southwest corner of Section
24; thence East 490 feet; thence Northerly alongside Highway Nos. 191 and 20,410 feet; thence

24; thence East 490 feet; thence Northerly alongside Highway Nos. 191 and 20,410 feet; thence
West 550 feet; thence South 440 feet to the point of beginning.

ITD Right-of Way:
Together with all rights of access between the right of way of the said project and the remaining
contiguous real property belonging to the Grantors, except for: Access to State Highway No. 88
West of Station 13+00 of said State Highway No. 88 Survey and East of Station 23+40 of said State
Highway No. 88 Survey.
At such hearing the City Council will hear all persons and all objections and recommendations
relative to such proposed annexation. The City Clerk will also accept written comments at City Hall
prior to 4:00 p.m. on February 15, 2022. This notice is given pursuant to the provisions of Section
67-6508, 67-6509 and 67-6511 Idaho Code, and all amendments thereof.
