On behalf of the University and myself, personally, I commend you for your very positive approach in seeking to identify and understand the issues which affect both of your cities. I am optimistic that your demonstrated commitment and leadership will lead to a mutually acceptable decision that might be embraced by the community as a whole. As directed, I have attempted to draft those issues which you both indicated would, at a minimum, need to be addressed in order for a consensus to be reached by your respective councils regarding the annexation of lands owned by Ball, Harris and Brown. It is my intent that the following items reflect the concepts and concerns which you presented and are not perceived as being driven or influenced by the involvement of others. These discussion points are presented in preparation for our next scheduled meeting on Tuesday, March 28, 2006 at 10:00 a.m. As discussed, please review these items and make corrections, amendments and additions as you deem appropriate. 1. Boundaries which are initially presented as possible acceptable solutions for (1) Sugar City and Rexburg city boundaries; and, (2) Sugar City and Rexburg Impact Area boundaries are attached hereto as Exhibits `A' and `B' respectively. 2. It is probable that the lands of Ball, Harris and Brown as well as quadrants of the North Rexburg interchange may eventually be located within differing city jurisdictions. Development occurring in areas where city boundaries adjoin should be based upon sound planning principles rather than upon financial or other jurisdictional advantages arising from locating in one city rather than the other. It is the mutual goal of Sugar City and Rexburg that development in such areas be pursuant to amutually accepted plan which will assure that land use, zoning, design of both site plan and type of structure is uniform and consistent across city boundaries. In achieving this goal, the cities acknowledge that uniformity and consistency should also exist as the two cities offer city services, including police and fire protection, and also in the establishing of fee schedules. If this goal is accomplished, the concerns expressed by individual property owners may be eased. 3. The cities recognize that the Rexburg sewage treatment plant, although owned by the city of Rexburg, is intended to serve the existing and future needs of Sugar City. Expansion of and necessary improvements to the treatment plant shall be funded by all entities utilizing the facility based upon a formula which reflects the amount of capacity utilized by each entity. Sugar City agrees that future capacity needs will be communicated to Rexburg in a timely manner and that funding by Sugar City will be committed prior to the development of expansion plans or the construction of such expansion. The cities will regularly review the anticipated future growth of Sugar City and determine the impact which such growth will have upon the sewage treatment plant as well as other infrastructure of Rexburg. 4. In developing lands located on the Ball, Harris and Brown properties which lie within the city limits of Sugar City, Rexburg will allow Sugar City to access the main sewer line located on Second East Street. Sugar City acknowledges that it is responsible to pay for the bringing of its sewer lines to Second East Street. 5. In developing future Impact Area boundaries, the cities agree that the Sugar City Cemetery shall be located in the Sugar City Impact Area.
