The DSH Living Trust is only requesting annexation. (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied” I. BACKGROUND The property is bare ground and may be used for agriculture. The parcels may be in the floodplain. II. SITE DESCRIPTION The parcels along W Hwy 33 & Main Street are contiguous to city limits. An application is being considered for an adjacent parcel, which will make all of the parcels for this application contiguous to city limits. The request is 58.491 acres. III. STAFF RECOMMENDATION Staff recommends that the Commission take public testimony and determine if the proposed annexation can be approved, denied or approved with conditions. Staff has reviewed the application and found it meets the requirements for annexation. ANALYSIS for Eriksons & Family Lmt Prt Only COMPREHENSIVE PLAN: Commercial/Mixed Use CURRENT ZONING: Community Business Center (CBC) REQUESTED ZONE: Mixed Use (MU) Also, at annexation, the Eriksons & Family Lmt Prt property is requesting a change in zoning from CBC to MU for parcels RP06N39E244821, RP06N39E244803, and RP06N39E244825. The proposed zoning area is 41.55 acres. The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. The Comprehensive Plan is in conformance with this application. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. • Water can be serviced off of 12th West. A sewer lift station will be needed to access the majority of the parcel. • For new development access will have to be off of 12th west. The Idaho Transportation department will be responsible for all access off of HWY 33. • A Traffic Impact study may need to be completed once we know the extent of the development. • All storm drainage will be handled on site. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. N/A e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. Within the last couple of months two Rexburg West Div. properties in this location are seeking annexation and zone change to Mixed Use (MU) (21-00755, 21-00754). The R Mountain Development at 20 S 12th W zoning was extended to create larger portions of Community Business Center (CBC) and Medium-Density Residential 2 (MDR2) (21-00084). In 2017, the parcels zoned Transitional Agriculture 1 (TAG1) and Transitional Agriculture 2 (TAG2) were rezoned to a single Transitional Agriculture (TAG) zone (20-00914). f. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the rezone of the parcels RP06N39E244821, RP06N39E244803, and RP06N39E244825 from Community Business Center (CBC) to Mixed Use (MU), if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
