§ 1.04.020 Zoning Map Revisions
AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The property contains Freddy’s, Mountain
America Credit Union, and the Mountain
America Call Center. These three (3) parcels are
the only remaining parcels that are zoned Central
Business District (CBD) due to the change in the
Downtown District to City-Center, Form-Based
Code,
The Rexburg Development Code allows the
Commission to make recommendations to the
City Council regarding whether or not the
property should or should not be rezoned based
on the criteria found in section §1.04.020.
II. SITE DESCRIPTION
The property is located on the northeast corner of N 2nd E and E main. There are multi-family
residential units and one, single-family home to the east, commercial to the north. The Downtown
District is to the west. South of this parcel is a Professional Plaza. The property is 2.6 acres.

III. ANALYSIS
If approved, the request will result in changing the
zoning at 18 N 2nd E, 220 Ricks Ave, & 227 E Main
from Central Business District (CBD) to
Community Business Center (CBC) for 2.6 acres.
The request would require the Commission and City
Council to review the proposal against one set of
criteria, for the request to rezone. Below, staff has
provided all the criteria listed by Ordinance No.
1200 (Development Code) that are required to be
addressed, followed by staff’s analysis of each
criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The request is in conformance with the Comprehensive Plan Map.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
There is capacity for water and sewer. The proposed zone will not stress the existing public streets.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services. N/A
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties. N/A
e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
The City-Center, Form-Based Code changed the Downtown District on the Comprehensive Plan
(21-00579) and was rezoned (21-00580) this year. The Professional Plaza was rezoned in 2020
from Low-Density, Residential 1 to Community Business Center (CBC). In 2019, Smith Park was
rezoned to Public Facilities (19-00093). The Mountain America Call Center was also built.
Freddy’s Frozzen Custard & Steakburgers was built in 2016.
f. Meets the requirements of the Development Code.
Following this request, a request will be considered to remove the Central Business District (CBD)
from the Development Code.
IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the rezone of 18 N 2nd E,
220 Ricks Ave, and 227 E Main from Central Business District (CBD) to Community Business Center
(CBC), if the Commission finds that the proposed request is compatible with the surrounding area or in
the best interest of the neighborhood and the community.
