This review cannot be completed and recognized because the following deficiencies were found: Please include a copy of the First Amended Plat for J&M Subdivision, Madison County instrument #181440, as referenced in the "Location 1" legal description. The legal description for the second description under "Location 4" (RP06N40E21 CR00) does not close to 1:5000. Please see Madison County recorded instrument #428520 for correction. Please make these corrections, have the ordinance re -recorded, and re -submit to the State Tax Commission in compliance with I.C. 63-215 and IDAPA Rule 35.01.03 255. Before this annexation/de-annexation can be processed for the 2022 year, the deficiencies listed need to be corrected. WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of Rexburg, Idaho,and have been laid off, subdivided or platted, and/or the City has been requested to annex the same to the City of Rexburg, Idaho;and WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described properties is subject to annexation to the City of Rexburg under and pursuant to the provisions of Section 50-222 - Category A, Idaho Code,and that said lands should be annexed to and become a part of the City of Rexburg, Idaho;and WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and Zoning Commission, and the Planning and Zoning Commission made its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed;and WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the properties to be annexed is as hereinafter set forth.
