Council Member Johnson asked to be excused. Discussion Regarding Street Re-Construction of Ricks-Palmer Subdivision as Pertains to Local Improvement District 51—Mayor Merrill and Keith Davidson Mayor Merrill welcomed everyone and introduced the city council members and city staff. He explained what an LID (Local Improvement District) is, how it works and who pays what. The cost is shared between the resident and the city. LID's add value to a home and make it look better. The LID method works well because residents can choose whether to pay the full amount up front or finance it over 10 years and make the payments with their utility bill. Some cities have much higher property taxes or use bonds to cover residential road and sidewalk repairs. Rexburg has much lower property taxes. A bond would require every city resident to pay more over several years;whereas an LID is paid just by the homeowners whose property is being improved. One gentleman commented that most of the residents do not want to pay a lump sum and might prefer to pay for a bond. Mayor Merrill indicated that generally, those who are facing an LID will say they prefer a bond but those who are not facing an LID do not support a bond. The gentleman asked if the city has ever asked the Rexburg residents what they prefer. Has a study ever been done to find out if the residents would support a bond over LID's? Mayor Merrill replied that a study has not been done but general input from residents indicates that they prefer LIDS over a bond. He also pointed out that Rexburg has one of the lowest property tax rates in Idaho at$178/person compared to cities like Idaho Falls that charge $588/person. One woman indicated that most of the people in this LID are low to middle income and cannot afford $10,000 to cover this LID expense. She would rather pay higher taxes. She said no one likes bonds but she would also like to see a survey taken to see what Rexburg residents prefer. Mayor Merrill explained that there are always a mix of incomes within an LID. The tax levy rate is already set and cannot be changed. 1 Discussion about home values and construction costs affecting property taxes. Public Works Director Davidson explained how the fixed tax levy rate works. It increases by 3% each year but it does not increase the pie,it only shifts the funds. Staff Accountant,Noah Phethean clarified that while new construction and home values may go up, commercial values might go down, so it is adjusted accordingly. This is a county function. A resident asked how the amounts for each homeowner was derived. Director Davidson explained how they look at the sidewalks to see if they need replaced, they bring in a survey camera to determine any drainage issues, they measure each property and look at many other factors to calculate each homeowner's cost. He indicated that the costs are estimated based off previous costs. They will not have hard numbers until the job is bid out. Discussion about estimates and prices going up. A resident asked if they would keep good concrete and replace just the bad concrete. Director Davidson replied that the concrete must meet criteria. They will only replace the concrete that needs replaced. If there is a short piece in the middle of bad pieces,it may be easier to replace the whole section. Mayor Merrill informed the residents that they are allowed to replace their sidewalks themselves or contract it out to someone else if it will save them money,but the sidewalk must meet the requirements. Residents are not allowed to do the curb themselves because the curb must be uniform the whole length of the street. Each homeowner is also welcome to do their own landscaping. One gentlemen asked if other utilities will be upgraded at the same time, such as electricity and internet. He works from home so having reliable, high-speed internet is important to him. If he knows that other services will be upgraded, he will be happier with the LID. Director Davidson said they always try to upgrade everything while the road is tore up because they do not want anyone cutting into the new roads to make repairs or upgrades later. Mayor Merrill informed the residents that the city is working on getting a broadband ring and fiber to each of the homes. The conduit for fiber will be installed. One resident is upset that their streets were tore up two years ago,but no storm drain was added and now the new concrete is breaking up. He wants to know why the city didn't plan better to do this project at the same time. Another gentleman agrees that the previous work that was done to install a water main down their streets was done very poorly. He had to fix the work they did. He wants to know who will be held responsible because nothing was done before. Director Davidson indicated that there is a one-year warranty. One lady wanted to know how other neighborhoods have reacted to LIDS. Mayor Merrill said they have had the same concerns, but the city works with everyone to answer their questions and eliminate their concerns. Questions were raised about driveway replacement. Director Davidson indicated that driveways must meet ADA requirements. If driveways meet standards, they will not be replaced. Only the pedestrian right of ways across driveways are affected. 2 Discussion about mailboxes. Someone asked when the LID will be voted on. The city doesn't know,yet. Another person asked if it can be delayed a year. That is up to City Council. Council President Busby commented that City Council listens to their concerns. He said one neighborhood did not want the LID, so council did not pass it. Now that neighborhood regrets their decision because costs to improve their roads and sidewalks have gone up. Someone asked if part of the work can be done. Director Davidson said they prefer to do the job right and complete the first time. Discussion about sewer line depth. Questions were raised about financing. Mayor Merrill explained that the cost can be spread out over 10 years and added to their monthly utility bill. If it can't be paid,it accrues and builds up with a 10%penalty for non-payment. If the home is sold with a balance still owing, a lean is placed on the property. Discussion about problems on Park Street. Someone asked about wear and tear from people attending the fairgrounds. Mayor Merrill indicated that every neighborhood has some high traffic areas. The city pays for road repairs as needed. Mayor Merrill continued the presentation, discussing the two options the residents have. One option is to narrow the streets and add grass strips between the road and sidewalk. This option will slow down traffic,provide a strip for snow removal in the winter, create better space for mailboxes and cost less for asphalt repair. The other option is to leave it the way it is and just do the upgrades and repairs. If they choose to narrow the streets,the city will pay more of the cost share. Most of the residents prefer to leave it the way it is. They held their own neighborhood meeting and that was the favored option. Some are concerned about parking on a narrower street. Some do not want the added expense of watering the grass strip. Council Member Walker suggested they wait until Park Street is done and then see how they like the narrower road. Park Street should be done in October. Discussion about home values and safety. Council Member Wolfe indicated that narrowing the streets makes more sense,but City Council has not made up their mind. They want what the residents want. Council President Busby agrees. He said they are looking for input from the residents. No decision has been made. Council Member Walker told the residents that they need to attend the public hearing and voice their concerns. Mayor Merrill said they are welcome to come into City Hall to discuss any questions they have. Someone asked if one street can be narrowed and the other streets not. Director Davidson said it is open for discussion. 3 One gentleman said he appreciates the communication. He would like to see easier access to information on the city website. Another gentleman would like to see a survey go out to all city residents to see if they prefer LIDS or a bond. At 7:10 people began to leave. Letters were handed out to each homeowner as they left. Mayor Merrill, Director Davidson, Council Members and Staff stayed to answer questions until 8:00 p.m. Letters that went out to the resident's regarding LID 51, state the following: It is the practice of the City to outsource the actual construction of these types ofproject to contractors. The City conducts a competitive bid to secure the best price and value for the project. For the road reconstruction on Chad, Angela, and portions of Marianne and 5th West the City is considering two options: a Road Narrowing or a Repair of the Existing Road. The costs shown below are our engineering estimates that the City has put together before receiving actual contract bids. (The City will not know the full cost to each property owner until all work is complete at the end of the LID)No payments are due until all of the work is complete and the total project cost is presented to the City Council, most likely at the beginning of 2023. There are cost savings with the narrowing of the road. Those cost saving are split between property owners. Under this construction plan, the property owner will pay the lessor of the two plans. Green space between the sidewalk and the road will provide space for snow. Mailboxes can go in the green space. ADA compliance is a large factor driving the need for addition improvements. Sidewalk slope from side to side cannot exceed 2 degrees in slope from side to side. In order to meet federal slope standard, large portions of the driveway will need to be improved. Sidewalk width cannot be less than 4 feet. With mail boxes on the sidewalk, there will need to be bump outs for sidewalk to maintain 4 foot widths.
