PROPERTY LOCATION: Rexburg West DIV1 – All lots except Blk 1 Lot 1 COMPREHENSIVE PLAN: Commercial/Mixed Use CURRENT ZONING: Community Business Center (CBC) PROPOSED ZONING: Mixed Use (MU) APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Zoning Map Revisions AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND In 2019, application for a Final Plat for 12th W & Hwy. 33 area was received. The plat was recorded August 11, 2020 as Rexburg West, Division No. 1. In October of 2019, a lot line adjustment was recorded for Blk 1 Lot 1 to reconcile the lot line for Dr. Fullmer and Matthew Griffith of Blk 1 Lot 2. The Rexburg Development Code allows the Commission to make recommendations to the City Council regarding whether or not the property should or should not be rezoned based on the criteria found in section §1.04.020. II. SITE DESCRIPTION The property is located on the north east corner of N 12th W and W Main Street. The lots are platted as the Rexburg West, Division No. 1 subdivision. The plat contains a total of eighteen (18) lots designated within five (5) blocks. Only Blk1 Lot1 has been built on. Blk 1 Lot 1 has a medical office and surgical center and this is a permitted use under the current Community Business Center (CBC) zoning. West of this parcel are residential homes and commercial businesses. North of this Plat is agriculture. South of this Plat is a commercial business park for Valley Wide Cooperative. The total area for the request is 7 acres. III. ANALYSIS If approved the request will result in changing the zoning of all lots except Blk1 Lot 1 from Community Business Center (CBC) to Mixed Use (MU) for 7 acres. The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. The request is in conformance with the Comprehensive Plan Map. The challenge is that this request is not contiguous to any other Mixed-Use parcels and is 0.9 miles away from the nearest Mixed-Use parcel. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. There is capacity for water and sewer. The needed access will stress the existing public streets. A Traffic Impact Study will be needed to see what street improvements, if any, would be needed for the development. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. N/A e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. This year, the R Mountain Development (21-00084), was approved for a rezone to extend the zoning on the parcels of Community Business Center (CBC) and Medium-Density Residential 2 (MDR2). A request for the Birch Property at approx. 301 S 12th W to rezone from Rural Residential 2 (RR2) to Low-Density Residential 2 (LDR2) and Medium-Density Residential 1 (MDR1) was denied. A second request for a rezone of the Birch Property to Low-Density Residential 1 (LDR1), Low-Density Residential 2 (LDR2), and Low-Density Residential 3 (LDR3) was also denied. f. Meets the requirements of the Development Code. The request meets the requirements of the Development Code. Case No. 21 00755 Page 3 IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the rezone of lots in the Rexburg West Division No. 1 subdivision except Blk1 Lot 1 from Community Business Center (CBC) to Mixed-Use (MU), if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
