§ 1.04.020 Zoning Map Revisions
I. BACKGROUND
In 2020, this parcel was rezoned from Transitional Agriculture 1
or 2 to a single Transitional Agriculture zone (20-00914), as it
was in the City of Rexburg’s Impact Area. This parcel is located
in the flood plain. The development would have to follow all
flood plain requirements.
II. SITE DESCRIPTION
The parcel is a flag lot located east of N 12th W with the stand of
the flag touching W Main Street. The parcel is 18.66 acres.
III. STAFF RECOMMENDATION
Staff recommends that the Commission take public testimony
and determine if the proposed annexation can be approved,
denied or approved with conditions. Staff has reviewed the
application and found it meets the requirements for
annexation.

IV. ANALYSIS
COMPREHENSIVE PLAN: Commercial/Mixed Use (listed incorrectly on application)
CURRENT ZONING: Transitional Agriculture (TAG) & Community Business
Center (CBC)
REQUESTED ZONE: Mixed Use (MU)
Also, at annexation, the applicant is requesting a change in
zoning from TAG & CBC to MU. The parcel has a
Commercial/Mixed Use designation on the Comprehensive
Plan. The flag portion of the lot is zoned Transitional
Agriculture (TAG) and the “stand” is Community Business
Center (CBC).
The request would require the Commission and City
Council to review the proposal against one set of criteria,
for the request to rezone. Below, staff has provided all the
criteria listed by Ordinance No. 1200 (Development Code)
that are required to be addressed, followed by staff’s
analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The Comprehensive Plan is in conformance with this application.
b. The capacity of existing public streets, water and sewer facilities, storm drainage
facilities, solid waste collection and disposal, and other utilities.
The sewer would need a lift station constructed to handle the sewer flow. Water can access
the parcel. A Traffic Impact Study would be needed to determine the extent of
improvements needed once a development is proposed. All storm drain requirements would
need to be handled on site.
c. The capacity of existing public services, including but not limited to, public
safety services, public emergency services, schools, and parks and recreational
services. N/A
d. The potential for nuisances or health and safety hazards that may adversely affect
adjoining properties. N/A
e. Recent changes in land use on adjoining properties or in the neighborhood of the map
revision.
This year, the R Mountain Development (21-00084), was approved for a rezone to extend
the zoning on the parcels of Community Business Center (CBC) and Medium-Density
Residential 2 (MDR2). A request for the Birch Property at approx. 301 S 12th W to rezone
from Rural Residential 2 (RR2) to Low-Density Residential 2 (LDR2) and Medium-
Density Residential 1 (MDR1) was denied. A second request for a rezone of the Birch

Property to Low-Density Residential 1 (LDR1), Low-Density Residential 2 (LDR2), and
Low-Density Residential 3 (LDR3) was also denied.
f. Meets the requirements of the Development Code.
The request meets the requirements of the Development Code.
V. STAFF RECOMMENDATION
Staff is neutral to the request. If the Commission finds that the proposed request is compatible
with the surrounding area or in the best interest of the neighborhood and the community, the
change would result in a rezone from Transitional Agriculture (TAG) and Community Business
Center (CBC) to Mixed Use (MU).
