HomeMy WebLinkAboutOrd 1268 Rezone 2331 W 2000 S to CBC/ ORDINANCE NO. 1268 Rezone Approximately 2331 W 2000 S from Low Density Residential 2 (LDR2) to Community Business Center (CBC) Zone AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed with the city clerk thereof, be, and the same is hereby amended and changed to provide that the hereinafter described property situated in the City of Rexburg, Madison County, State of Idaho, regarding (#21 00622) to rezone approximately 2331 W 2000 S, Parcel No. RPRXBCA0014217 from Low Density Residential 2 (LDR2) to Community Business Center (CBC) zone in the City of Rexburg, Madison County, Idaho. The legal description of the said property in Rexburg, Madison County, Idaho, is as follows: Legal Description: A parcel of land being a portion of Government Lots 3 and 4 located in Section 1 and a portion of Government Lot 1 located in Section 2, Township 5 North, Range 39 East, Boise Meridian, Madison County, Idaho more particularly described as follows: Commencing at the Northwest corner of said Section 1, being marked by a 5/8” rebar with an aluminum cap as shown on Corner Perpetuation and Filing, Instrument No. 395361, said point being the Point of Beginning; thence along the North line of said Section 1, North 89°56’16” East 798.37 feet; thence along a line parallel with the West line of Section 1, South 00°00’51” West 614.71 feet to the North line as shown on Record of Survey, Instrument No. 265470; thence along said North line, South 89° 54’58” West 537.22 feet; thence South 00°02’23” West 718.10 feet to the South line of Government Lot 4 of Section 1; thence along said South line, South 89°53’01” West 260.83 feet to the West Quarter corner of Section 1; thence along the West line of said Section 1, North 00°00’51” East 1333.26 feet to the Point of Beginning. SUBJECT TO: The Right-of-Way of the W. 2000 S. County Road along the Northerly portion of the above described parcel. Parcel contains 15.572 acres. SECTION II: That a new zoning map showing these amendments shall be certified to and declared to be the official zoning map of the City of Rexburg by passage of this Ordinance by the City Council of the City of Rexburg. SECTION III: This ordinance shall become effective upon its passage, approval and publication.
