§ 1.04.020 Zoning Map Revisions
AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The parcel is currently used as an agriculture farm.
The Rexburg Development Code allows the Commission to make recommendations to the City
Council regarding whether or not the property should or should not be rezoned based on the criteria
found in section §1.04.020.
II. SITE DESCRIPTION
The property is located west of S Yellowstone Hwy
and the railroad tracks. West of this parcel are the
Riverwoods Townhomes. North of this property is the
Trejo Business Park. The total area for the lot is 2.1
acres.
III. ANALYSIS
If approved the request will result in changing the
zoning of the parcel from Community Business Center
(CBC) to High-Density Residential 1 (HDR1) for 2.1 acres.

The request would require the Commission and City Council to review the proposal against one set of
criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200
(Development Code) that are required to be addressed, followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The request is in conformance with the Comprehensive Plan Map.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
There is capacity for water and sewer. The needed access will stress the existing public streets.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.

d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.

e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
The Trejo Business Park was platted in 2004 (04-00057). In 2005, the Trejo Business Park was
rezoned from Light Industrial and Highway Business District to Technology Office Zone (05-
00085). In 2020, the Trejo Business Park was rezoned from Technology Office Zone to
Community Business Center (20-00690). The Riverwoods Townhomes Phase 2 went in in 2004
with a PUD. Riverwoods Townhomes Phase 3 went in in 2009.

IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the rezone of the land
South of the church at approximately 547 Trejo St, parcel RPRWSTAT020070, which will change the zone
from Community Business Center (CBC) to High-Density Residential 1 (HDR1), if the Commission finds
that the proposed request is compatible with the surrounding area or in the best interest of the
neighborhood and the community.
