Roll Call of Planning and Zoning Commissioners: Present: David Pulsipher, Todd Marx, Sally Smith, Aaron Richards, Jim Lawrence, Bruce Casper. Absent: Chairman Rory Kunz, Greg Blacker, John Bowen, Vince Haley, Randall Kempton. Minutes: Planning and Zoning meeting August 19, 2021 (action) MOTION: Motion to approve the Planning & Zoning minutes for August 19, 2021, as recorded, Action: Approve, Moved by Sally Smith, Seconded by Aaron Richards. Commissioner Discussion on the Motion: None VOTE: Vote: Motion passed (summary: Yes = 5, No = 0, Abstain = 1). Yes: Aaron Richards, Bruce Casper, Jim Lawrence, Sally Smith, Todd Marx. Abstain: David Pulsipher. Public Hearings: 1. 6:35PM – Form-Based Code – (21-00579) – Comprehensive Plan Map & Text Amendments – Add City-Center, Form-Based Code to the Summary Table of Appropriate Land Uses to a City-Center, Form-Based Code designation with allowed transect zoning of Core, Main Street, City Center, and Residential. Change all parcels from S 2nd W to S 2nd E and W 2nd S to E 1st N from Commercial/Mixed Use and MDR1-HDR2 (action) - Alan Parkinson Applicant Presentation: The change in the Comprehensive Plan Map for the Downtown District will be established. This includes twelve blocks from S 2nd W to S 2nd E and W 2nd S to E 1st N. The Downtown District will be the City-Center, Form-based code. Alan answered anything that exists in this area would be grandfathered in. Only at time of a major change will the form-based code apply for commercial and residential. Aaron said because this application covers so many properties, was it published in the newspaper? Alan answered the notification was in the newspaper and on social media. Social media is another way to get the information out to the public, so they are aware of what is happening. Commissioner Questions: None Chairman opened the public input portion of the hearing at 6:40PM. Favor: None Neutral: Vincent Huber – 76 W Main – His concern was about what would be grandfathered in. He asked how the three stories were measured. Is this above ground for a residential place? Alan answered the stories are measured above ground level; a basement is not counted. Opposed: None Written Correspondence: None Rebuttal: None Chairman asked if anyone else would like to speak. He closed the public input portion of the hearing at 6:42PM. Conflict of Interest? – Chairman asked the Commissioners if they have a conflict of interest or if they have been approached by any parties relative to this particular subject. If you believe your prior contact with respect to this subject has created a bias, you should recuse yourself, otherwise at this time please indicate the nature of your conversation or contact. None. Commissioner Discussion: Jim said this is good and goes along with what the Commission is trying to accomplish. MOTION: Recommend City Council approve the Comprehensive Plan Map and text amendments for form-based code for all parcels from S 2nd W to S 2nd E and W 2nd S to E 1st N, because the request fits well with the direction we want to see the City go., Action: Approve, Moved by Jim Lawrence, Seconded by Aaron Richards. Yes: Aaron Richards, Bruce Casper, David Pulsipher, Jim Lawrence, Sally Smith, Todd Marx. 2. 6:40PM Form-Based Code - (21-00580) – Rezone parcels to match the Regulating Map. Change all parcels from S 2nd W to S 2nd E and W 2nd S to E 1st N from their current zone to approved Transects. action) - Alan Parkinson Applicant Presentation: The next step is to rezone the areas within the district, so we have the proper transects 3 within the Comprehensive Plan Map area. There will be Core, City-Center, Main Street, and Residential to match the regulating map passed in the Development Code, City-Center chapter. Staff has been through this form-based code. This action will show where each of the transects will be located. Staff recommends the request to the Commission and then to City Council for approval. Commissioner Questions: David asked what the logic was for designating one block as residential? He understands the logic for the other areas. Alan said that block is so close to the university and residential areas, this created a buffer between the commercial and nearby residential areas. Down the road, there could be a change in transect. Aaron asked the difference between the last action item a couple of weeks ago and tonight’s action item. How are these different? Alan answered the action two weeks ago was modifying the Development Code creating the standards and rules for the different transects and this downtown area. Now, we are matching the Comprehensive Plan and rezoning the transects to establish areas for those rules and regulations. Aaron confirmed City Council approved the first reading of the Form-Based Code last night. Alan said there will be two more readings on the code. David asked if the rezone requires three reads. Alan said it does. City Council wants citizens to have ample time to hear what is going on and be able to respond. Commissioner Discussion: Sally asked if we pass this tonight, what will be next? Alan answered, once it is passed through City Council, the form-based code will be enforced. The public can begin submitting applications. Sally asked if the City intends to see applications coming. Alan stated there are several people interested, and have brought ideas to the Staff, but they are waiting until this code is formally in place. The City has a project they want to start and help guide. Soon afterwards, the Central Business District for the downtown will be removed. This was a request that would have happened tonight, but there are two parcels outside of this area will need to be rezoned prior to removal of the Central Business District from the Development Code. The City is seeking their permission. Aaron asked at what point this code becomes an actual ordinance. Alan confirmed the ordinance is in place at the approval of the third read, with a meeting twice a month this will be six more weeks. 4 Jim says it is exciting to finally get this code in place. It is a great opportunity for us to get our downtown the way we want it to be. MOTION: Move to recommend Council rezone the parcels from S 2nd W to S 2nd E and W 2nd S to E 1st N to match the Regulating Map for the City-Center, Form-based Code, because the development codes have been adopted, as well as the Comprehensive Plan; this request is following suit., Action: Approve, Moved by Aaron Richards, Seconded by Jim Lawrence. (21-00623) Rexburg 32 – Comprehensive Plan Map Change from Rural to Commercial/Mixed Use 2. (21-00622) Rexburg 32 – Rezone portion of parcel that is Low-Density Residential 2 (LDR2) to Community Business Center (CBC) Last night, City Council tabled the Mobile Food Court Ordinance & Mobile Vendor Ordinance with Business Registration changes. Aaron clarified the work meeting will be held at 5PM on September 15, 2021, and the Planning & Zoning meeting will be held at its regularly scheduled time on September 16th. City Council wanted a little more time and invite the vendors at the work meeting to fine-tune this ordinance. Staff received this request from City Council to make these changes, so Staff has no objections. Jim confirmed the actions for September 16th are new requests the Commission will be seeing. Alan shared an annexation request was announced at the City Council meeting. An annexation takes a twenty-eight-day notification, time frame in the newspaper. It will be October at the earliest. Aaron asked if the request is a voluntary annexation. Alan answered the annexations are voluntary; most of the annexation land is city-owned property. One landowner had an agreement, when they hooked up to city water and sewer; they agreed to annexation. David asked if the parcels are in the same location. The parcels are scattered in seven areas with a total of approximately forty acres. Adjournment at 6:54PM
