SUBJECT: Automatic Sprinkling System Required for Valley Medical Shoppe 3 P.0. BOX 280 12 NORTH CENTER STREET E BR , IDAHO 83440 PHONE (208) 359,.3020 FAX ('208) 359-3022 The Building Permit Application for the Valley Medical onoppe was lssuectcn w-ith the note that the plans and construction were "subject to Rulon Nielsen Pian Check" . Rulon Nielsen was the city -hired architect who reviewed the Valley Medical Shoppe plans for the city. His ,letter of October 9. x.993, listed 13 items whereunder the building plans needed to changed, added to, or clarified in some manner. The plans should have been changed or corrected and then resubmi*tted the city for further checking and approval. They were 'not chang.ed nor resubmitted. The coniractor, Sart Stevens, has made many of the indicated changes and corrections as he has constructed the building, The major item that has not been corrected is item 457. covering the need for ars ;'automatic sprinkling system in the baseme:at to I 1JA2 =u ILuux•alx�.�u�fa�ng �:a�e t u�s�:} SE��ioT1 3802 (b) requires an automatic sprinkling systeri fob ,the subjec� building;; or, as a possible alternative, it requires (in thi�s. case) 40 square feet of opening entirely above the ground level (with a tnirzimum opening dimension of not fess than 30 inches.) Also, "such openings shall be accessible to the fire department from the exterior and shall not be obstructed in a manner that fire fighting or rescue cannot be accomplished from the exterior". (See attached Copy of UB C marked Exhibit A) The subject building does not meet either of these requzrements . It dues not have an automatic sprinkling system however, an attempt was made to provide exterior Qpenirxgs . It has two 4'x4' windows (totaling 32 square feet of opening). The windows are not "entirely above the gEound level". Each window emits to a 22'1 wide by 6' -long by 6 1/2' high window well. T'he window wells are so narrow that they provide Poor accessibility to or from the basement. (Note: Other cries have allowed access towi ndow wells instead of the openings having to be "above the ground level") however, they have required the window wens to be at least 51idewperpendicular to the basement wall} Consequently, this buildings basement does.- not have adequate openings (neither :size nor accessibiffity) to the exterior. The contractor believes he was given verbal approval by the City Fire Marshall and/or the Building Inspector that Providing the basement, windows and window wells on the north side of the building would eliminate the -need dor an automatic sprinkling system. There apparently were several discussions 'between the contractor and the city's Fire Marshall, Building Inspector and Water Superintendent. The qty's personnel do not agree that 0 They gave the contractor permission to eliminate the automatic sprinkling system. The previous City wilding Inspector, Terry Leishman, quiff working for the city on November 4, 1993, a few weeks after the building permit for the Valley Medical Shoppe was 'issued.. The city's architect, Rulon Nielsen, wrote a second letter to the city (dated December 2a, 1993) giving a number of reasons why the sprinkling system was still needed. He also stated that his fetter was necessary to: 'remove me from possible liability exposuredue to the decision by the Fire Inspector to -not require sprinklers in the Valley Medical Shoppe.11 The present situation is as follows0 N 1. -L ne owner car tne eualdUng eves not vivant an automatic sprinkling system because he has had Ahern turn on (for no reasorz) and ruin items due to water damage. 2. The contractor says he understood that the windows and window wells he installed would make a sprinkling system unnecessary . 3. The windows and window wells he installed do not meet the UBC requirements for exterior openings that would maks a sprinkling systems unnecessary. 4. The pity has taken no darect action (other than its original direction on the Building Permit Application) to reaffirm that a sprinkling system was required. 5. The present water line on the east side of 2nd Easy is 211 in diameter. For a fire sprinkling systema 611 or 811 line would be needed.
