RE:
Construction of
new concrete wall
along port property line
e
of
new Beehive Credit
Union Building
Center Street
Dear Mr. Berger,
This letter written to reaffirm the previous dLscussxon
between you and I and alsothe earlier d iscussion between my -self
and Don Hammer at the time he was pouring the subject wall. As
we discussed, the City Zoning Ordinance, Section 4.7-B
Construct
. -
trut ion Requirements, sub sect mon a. - Frontage, states as
follows*
"The maximum height of any fence wall r other s ight
obstructing object within fifteen 1 feet of the
public right-of-way shall be three feet, Peaces shall
not be greater in height than eight feet."
The East edge of the Center Street Right-of-way i deet east
of the existing back- -sidewalk. indicated, the subject
all can not be more than 3 feet high within 15 feet cf the
rrt--way (or !+ 1 = 201 from the back of sidewalk).The
apparent. options are 1 cut the wall off down to a 3 foot
height* or o to the Planning & Zoni Committee and request
"variance" from the r finance to allowthe r
-constricted wail*
You will alsoneed to request approval from the Mayor and City
Count i l for the 51 of all that was constructed on street
right-of-way between the back -of -walk and the right-of-way line.
The original plans for the beehive Credit Union did not show
wall along the northerly property li- ne. Actually{ thei isng
residential use on the north should have been protected by a
"buffer zone" consistingof an approved fence or a 4 foot wide
landscaped strip planted with shade trees and low shrubs. see
attachedordinance, Sect ion A.1 - Parkina
Areas - Commercial, I r l Uses*) The residential use
to the south of your new building appears to be adequately
buffered by the landscaped strips that our plans show will b
constructed there around,.
Please call CILty Clerk,
discuss the subject wall
and the CityCouncil
Very Truly Yours,
Rose Bagley, to get on the agenda t

Tne purpose of tnis letter- is to respond to the letter'- we - -- -- -
received. from y -au and. the phone conversation that I recently had
with. Rose Bagley. We are aware that to be in compliance with the
amity zoning ordinance we must cut down portion of the cement
U11 L1lu :riortn sine of our property-,
We are alsoaware that the alternative would be to annrnarr r,a
city council tor a variance to this ordinance . The credit yyy
union's hoard of directors meet on the 30th of dune. At that
time we will discuss our options and decide whir_, one . r,
Shortly trereafter, we will either approach the planning and
zoning commission for a variance, or remove theportion of the
wall not in compliance. We are also warkirig with our generalI
contractor, 1aMOnt Merrill to correct the other items on the
correction notice we received from you.
If you have any other concerns, please
Sincerely,
