NOTICE OF CONTRACT OF SALE
NOTICE IS HEREBY GIVEN that R & G Taylor Investments, a
general Partnership consisting of Robert M. Taylor of 275 Harvard
Avenues
Rexburg,
Idaho
83440
and herald Taylor of
29Q Shoshone
Avenue,
Rexburg,
Idaho
83440,,
hereinafter called
"Seller" are
selling an written Contract of Sale of this same date, to
Millhollow Frozen Yogurts enc., an Idaho corporation, with its
principal place of business at 53 South Mild Hollow Road, Rexburg,
Idaho
83440,
hereinafter
called "Buffer,
"
the
following described
real
property
situated in
Madison
Countyf
to -wit:
Commencing
82.5
deet south of the Northeast corner of
Lot
4, Black 38
of
the original Rexburg 2'oWT151te , as per
the
recorded plat thereof, and running thence South 82.5
deet; thence West 177.5 feet; thence North 82.5 feet, a
portion of which distance runs along the outside of a
north. -south wall of a building; thence East 177.5 fejt to
the paint of beginning.
Subject to a perpetual easement for pedestrian egress
from emergency exits located or to be located an the
eastern most section of the building and property
bordering the property hereby sold an the west of the
f "t property hereby sold as sed forth in that certain Notice
of Contrast of Sale between R & G Investments, an Idaha
General Partnership as "Seller" and Marvin A. Gardner and
Shirley R. Gardner., husband and wife:, as "Buyer", dated
Mardi 12, 1984,, recorded in the official records of
Madison County, Idaho as Instrument No. 202968 an March
19, 1984.
Subject to provisions regarding party walls contained in
that certain Not -ice of Contract of Sale between R & G
Investments, an Idaho General Partnership as "seller"
and Marvin A. Gardner and Shirley R. Gardner, husband and
wife, as "Buyer" � dated March 12, 1984, rewarded in the
official records of Madison County, Idaho as Instrument
No. 202968 on March 19, 1984.
Subject to an easement, so lona as the chimney exists-,
for a chimney attached to the building located on the
property west of and contiguous to the property hereby
sold.
Seller hereby reserves ars easement twenty fest wide,
lying easy and west, the sough side of which easement
is two feet north and parallel to and along the entire
south boundary of the above described property fir
� ingress and egress for Seller and Sellerrs lessees,
assignees and successors in interest which easement
shall be appurtenant to the following des
cribed real
property:
Commencing 165 f South and 177.5 f West of
the Northeast corner of Lot 4, Block 38 of the
original Rexburg Townsite, as per the recorded
plat thereof, thence South 85 feet; thence West
52.5 feet; thence North 104.S feet; thence East 53
feet; thence South X9.5 feet to the point of
beginning;
Subject to easements, if any, of record or in existence
for roads, streets, pipelines and/or utilities.
The Contract of Sale is payable over a period of 10
years and is payable to Bank of Commerce, Idaho Falls', Idaho, as
escrow holder.
Buyer has possession,
but
the deed shall not be
delivered until
the Contract is
fuller
laid,
and Seiler retains
remedies in the event of default, all of which are fully set
forth in the contract of Sale and the Escrow Agreement.
