The fire department indicates they would not be opposed to a "grass--flled paver brick surfacing" provided the paving brick was supported by an adequate depth of pit run grave]. and 3/4" crushed gravel capable of sustaining the weight of their fire engines. The edges of the fire lane would also need to be delineated by raised bricks, a concrete edger strip or some such thing that would give clear Jef ini-Cion to t.'ie eages o .-Le ire ane. The soil 'in the n r l area of the site. is a silty loam to silty/clay. There is usually lay layer right the top of thesurface of the lava bedrock. Particularly during the Spring and sometimes during late Winter and early Summer, water runs along the surface of the lava bedrock. Bedrock is usually low the ground -surface, but this depth to bedrock is very variable.. The soil has a great capacity for capillary action. It wil 1 stick water from the top of l-. rack ace up to the bottom of the base ravel under roads rarkinjlots,or fire l ane s and sidewalks and create lenses of ice or a great deal of "frost heaving" as it is known in this area. `h 'is something you will reed to keep in mind as you deb i n the bul-lding footings, i s l parking lots, fire lane, etc. for the sub3ect uii- Rexburg has adopted the 1994 Uniform Building Code. l zone, w2-nd, etc. are shown on the attached Local values for Figure 1 IV It appears to me that thl-s type of facility would be a Group I, DI- visa"'on 2 occupancy. By changing from a condominium . rental unit, she can't get past that they have created the hardship them9elves. SheX's strugglinghow to base their decision when the next person comes in we know what to tell them, that is why she wondered about a zone change? John Millar told herC.B.D. does not allow for rental units. Stephen pointed out that when we say they, he did not think any of the present owners were i n these units were built. Randy Schwendiman stated that was approved as a condominium association .d i never was a oi-L :mss a -t ion , Whenever you say those that built it were the ones that created a problem, the city hadhand in that. The r was an agreement with them and the city. Stephen explained if the city granted a variance rrdi i i 1976, according to the minutes they came j -n and said they were going t put in condominiumsand that is what got the city to say they wouldnot hold them to the two parking placesper unit. We have to f ind a legal way to change that condominium can be rented. Mary Ann stated that It is not that we don i t want to give them more parking, we have to find a legal reason because if someone decided t sue because we gave it to Park Place and won't give it to t hem A We have to meet the guidelines. Randy stated that is a rental unit and if they don't get adequate parking, it will be turned into a rental unit that no one wants to own. Even with this parking they are short of parking but this is as close as they cern come. (discussion) Stephen stated that the problem was created through a two phase process, one thing we did not have the Planning .rd functioning as we do now and two we had an individual developing the land who probably misrepresented e could get the parkingapproved the way it was. it sounds like all along he knew these would be apartments but called them condaminiums so he could get the parking approved. At this int we are not hooking at who created the problem, in order to expand the parking e have to find legal rational reason to call this a variable unique circumstance. John Millar stated that if an error was made it was probably made twenty years ego and left a problem with no it ion # The uniqueness is we are trying to clean up something that happened twenty years ago.
