WARRANTY DEED
FOR VALUE RECEIVED, DOUGLAS E. YATES of 4028 S, 2000 W., Rexburg,
Idaho 83440 dealing with his sole and separate property, with his wife, DONNA YATES, who
claims no interest in the property, but joins in the execution of this deed to convey any doubtful
interest, hereinafter called "Grantor", hereby remise, release, and forever warrant unto RUSTIN
(RUSTY) TOWNSEND and KELLY JANE TOWNSEND, husband and wife, of 260 Shoshone,
Rexburg, Idaho 83440, hereinafter called "Grantee", the following premises, in Madison County,
state of Idaho, to -wit:
Lot 2 of the J & M Subdivision, as per the recorded plat thereof, also
described as: Beginning at the Northwest corner of Section 13, Township
b North, Range 39 East, Boise Meridian, thence South along the West
Section line of Section 13 for a distance of 700 feet; thence North
89°58'00" East for a distance of 52.5 feet to the true point of beginning;
thence North 89 58"00" East for a distance of 499.45 feet' thence South
280 feet, thence South 89°58'00" West 499.45 feet, thence North 280 feet
to the true point of beginning.
TO HAVE AND TO HOLD the said premises, with their appurtenances, unto the
said Grantee, its heirs and assigns forever. Grantor does hereby covenant to and with the said
Grantee, that they are the owner in fee simple of said premises; that they are free from all
encumbrances, EXCEPT AS SET FORTH HEREINABOVE, and that they will warrant and
defend the same from all lawful claims whatsoever, except as noted.
