DEVELOPMENT AGREEMENT
McDONALD'S RESTAURANT
AGREEMENT,, made this day of . 20QQ bX and between the
CITY OF REXBURG, a municipal.. corporation, hereinafter galled `LCity" 12 North Center,,
P -0 -Box 280., Rexburg,, Idaho, 8344D and McDONALDS CORPORATION, a Delaware
Corporation (hereinafter referred to as McDonalds ) whose mailing address is:
The following recitals of fact are a material part of this agreement:
1 ---
Developer desires to construct a new restaurant upon the property described in E �H�YB�T
"A" attached hereto.
2 --- The north walk of the proposed building is nine f9} feet sough of the north property line. In
accordancewith the Uniform Bui-Iding Code, a wail fess than 20 ft, from the poprerty
line or 20 ft. from the centerfine of an "adjoining public way" at this location would have
to have a 1 hour fire rating and windows/doors would have, t4 have a 314 hour fire raking.
3 --- North of the north property dine of McDonalds:;there is an existing a 28 fto wide shopping
mall roadway easement. In, a separate Easement Grant (Instrument No. 178123, dated
(April 18,, 1979,, copy attached hereto) McD alds has the ability to require this mail
roadway easement to remain in its -present location. The City would consider this
private roadway easement equal to an ""adjoining public wad", if McDonalds agrees to
retain this referenced mall roadway easement at its present location.
4 ___ Considering this 28 fto gide mall roadway easement as a permanent roadway, th1th wall
of the proposed new building would be 9 ft. + (112 of �S) = �3 ft. from the na�h wall to
the centerline of the shopping mall roadway easement, which is larger than the 20 ft.
distance required in the Uniform BuRding bode. Therefore the north building wall
would not have to have cone-hour fire rating and the windows/doors would not have to
have a 314 hour fire rating.

CONSIDERING THE ABOVE FACTS, the parties agree as follows:
A --- The City wx�� not require McD�nalds to construe the north wa11 to 1 hour fixe r�sis�zve
standards as long as it (McDonalds) requires the ZS ft. wide mail roadway easement to
remain in place.
T3 --- If for some reason, McDonalds.does not require the 28 ft. wide mall roadway easement
(alonar it's norther y property line) to rema.�n �n ids present location, then McDonalds
herewith agrees that it wild reconstruct it's north wa1�, doors, vv�nda�s, etc. to ore -hour
fire resistive standards or such ocher standards and requirements as the BuildingCade or
Fire Code in existence a� that time mai require. �
