FINDINGS OF FACT
FOR
ZONE CHANGE FOR THUESON FAMILY TRUST
1. On October 24, 2001, Mike Thueson, on behalf of the Thueson Family Trust, presented to the
Rexburg City Clerk a Request and Application for Zone Change on property located on the
southwest comer of West Main and 4' West in the City of Rexburg. The request is for said
property to be changed from Medium Density Residential/Professional Overlay (MDR/PO) to
High Density Residential 2 (HDR2).
2. On October 24, 2001, Mike Thueson appeared on behalf of the Thueson Family Trust before the
Planning & Zoning Commission for the City of Rexburg requesting a zone change of said property
from Medium Density Residential/Professional Overlay (MDR/PO) to High Density Residential 2
(HDR2). It was recommended by Planning & Zoning that this request go to public hearing.
On October 25, 2001, the City Clerk sent the Notice of Public Hearing advertising a public
hearing before the Planning & Zoning Commission on November 14, 2001, for publication in the
local newspaper on October 29 and November 7, 2001, posted a notice on the property and sent
notices to all property owners within 300 feet of the above mentioned property.
4. On November 14, 2001, Mike Thueson appeared on behalf of the Thueson Family Trust before
the Planning & Zoning Commission for the City of Rexburg requesting a zone change from
MDR/PO to HDR2 on property located on the southwest corner of West Main and 4' West in the
City of Rexburg. There was one public comment in opposition to the zone change because of the
perceived difference it would make in his neighborhood. It was recommend by Planning &
Zoning that this request for zone change be approved for public hearing before the City Council.
5. On November 15, 2001, the City Clerk sent the Notice of Public Hearing advertising a public
hearing before the City Council on December 19, 2001, for publication in the local newspaper on
November 30 and December 12, 2001, posted a notice on the property and sent notices to all
property owners within 300 feet of the above mentioned property.
6. On December 19, 2001, Mike Thueson on behalf of the Thueson Family Trust appeared before the
City Council of the City of Rexburg requesting a zone change from Medium Density
Residential/Professional Overlay (MDR/PO) to High Density Residential 2 (HDR2) on property
located at the southwest corner of West Main and 4`h West. There was no public comment
concerning this request. After discussion it was moved and approved that on the recommendation
of the Planning & Zoning Commission this request for High Density Residential 2 (HDR2) be
granted as requested.
