Dear John:
Enclosed is a copy of the Findings of Fact for the Conditional Use Permit for T Test for the
Rite-Aid building located at 125 Valley River Dr.
Yours truly,
CITY OF REXBURG
Marilyn Wasden
City Clerk
FINDINGS OF FACT
FOR
CONDITIONAL USE PERMIT FOR T TEST
1. On September 18, 2001, John Watson on behalf of T Test Corporation presented to the
Rexburg City Clerk a Request and Application for Conditional Use Permit for property
known as the Rite Aid Building located at 125 Valley River Drive in the City of
Rexburg. The Conditional Use Permit is requested for T Test to use the building for
manufacturing, packaging and labeling their products.
2. On September 26, 2001, John Watson on behalf of T Test appeared before the Planning
& Zoning Commission for the City of Rexburg requesting a Conditional Use Permit for
property known as the Rite Aid Building located at 125 Valley River Drive in Rexburg,
said building to be used for manufacturing, packaging and labeling their products. After
lengthy discussion it was moved that this request be approved for public hearing before
the City Council with the following conditions:
That all safety services review the plans
That T Test employees park on the west side of the Rite Aid building and the
north side of the K Mart building.
That T Test return in two years for a review of the business compatibility in the
location and the parking situation.
3. On October 2, 2001, the City Clerk sent the Notice of Public Hearing advertising a
public hearing before the Planning & Zoning Commission on October 24, 2001, for
publication in the local newspaper on October 8 and 17, 2001, posted a notice on the
property and sent notices to all property owners within 300 feet of the above mentioned
property.
4. On October 24, 2001, John Watson on behalf of T Test appeared before the Planning &
Zoning Commission for the City of Rexburg requesting the public hearing be cancelled
until further advised since T Test had not signed a lease for the Rite-Aid building.
