NATURE OF REQUEST: Briefly explain the proposed use:
Construct a new building at the Spori Building location to replace the academic
space taken out of service when the Spori Building was demolished. The
replacement building is approximately 44,000 square feet.

REQUIREMENTS FOR GRANTING CONDITIONAL USE PERMIT:
The following information will assist the Commission and/or City Council to determine if your
proposal will meet the requirements under the zoning ordinance.
1. What is the estimated water usage per month? Are the existing mains adequate to provide fire
protection? 28 Gallons per Month. Existing system will support fire protection

3. What is the estimated daily traffic to be generated? Will the traffic be primarily private
vehicles or commercial trucks? 35 cars per day for employees. This will be private
vehicles and no commercia trucks. Student parking needs to be determined by
University Parking Evaluation Committee.
4. If commercial, industrial, or a home occupation, what will be the hours of operation?
5. Will storm water drainage be retained on site? Is an existing storm drain available? Is it at
capacity? If so, will new facilities be constructed? Storm water will be discharged into
existing system drainge at the north end of campus.
6. If proposed use is residential, describe number and type of dwelling units. Will this be
student housing: multi -family for young families, singles and couples, or elderly?
7. What provision has been made for fire protection? Where is the nearest fire hydrant? Is any
point of the building further than 150 feet from access sufficient in width for fire fighting
equipment? Building will have a fire sprinkler. Fire hydrant is 40' away.

with the ordinance requirements? Has landscaping been provided in accordance with the
ordinance?The Campus has 1,600 stalls on campus and 1,768 on street parking within
the campus boundaries. 382 additional stalls are planned on-site for the Multi -

9. Where will solid waste generated be stored? Is access adequate for the City collection?
Solid waste is handled by the College
10. What is the type of noise that will be generated by the use? What are the hours of noise
generation? No noise will be generated outside of the structure.
11. What type of equipment will be used in the conduct of the business? Art Studio Equipment
Classroom and Office Furniture/Broadcast Studio Equipment
12. What are the surrounding land uses? Has buffering been provided as required by the
ordinance? University and Apartments
13. Are any air quality permits required? Is dirt or other dust creating materials moved by open
trucks or boxcars? No air quality permits required. No dirt or dust.
14. Will the parking lots or other outdoor areas have lighting? Yes. Building perimeter lighting
will be used for personal safety.
15. Are passenger loading zones for such uses as daycare centers and schools provided? How is
busing routed? For commercial uses, where are the loading docks? Is there sufficient space for

CONDITIONAL USE PERMIT PROCEDURES
The City of Rexburg Zoning Ordinance designates certain land uses in each Zoning District
which are allowed. These are listed in the Zoning Ordinance for each zone. The City Clerk or
City engineer should be consulted if you have questions about whether your proposal will need a
Conditional Use Permit.
If a C.U.P. is needed, you will need to get an application from the City. Clerk and fill it out for a
C.U.P. You will then need to return the application and request that the City Clerk put you on
the Planning Commission agenda one week prior to the meeting. The Planning & Zoning
Meetings are held on the 2' and 4' Wednesday of every month at 7:00 p.m.
The City Clerk will then mail to the Planning Commission the application for them to review
prior to the meeting. At the meeting the board will discuss your request with you and set it for
Public Hearing. You will need to pay $200.00 to the City Clerk prior to any advertising for the
hearing. Prior to granting a conditional use, at least one Public Hearing shall be held to give
persons an opportunity to be heard.
The City Clerk will put the notice for the hearing in the paper 15 days prior to each hearing, mail
a copy to all the property owners within 300 feet and post a notice on the property. After the
Planning Board holds their hearing they will make a recommendation to the City Council. The
City Council will take the Planning Board recommendation into consideration. If a hearing is
required before the City Council they will then take into consideration oral and written
testimony as well as the recommendation from the Planning Board. A decision will be made by
the City Council within the time frame allowed by Section 67-6511, Idaho Code.

ADDENDUM TO APPLICATION FOR CONDITIONAL USE PERMIT
This addendum outlines the basic philosophy Ricks College has adopted over the years with
respect to meeting the parking needs of our students, employees, and visitors and is submitted to
the city of Rexburg as a means of fostering better communication and understanding between the
city and the institution.
In relation to parking issues, there are two general classifications into which most colleges and
universities can be placed:
Commuter Campuses - Those where the majority of students continue to live at their
homes within the surrounding communities and drive daily to campus. Most community
colleges fall within this category. Extensive parking and/or public transportation options
are necessary to serve these campuses.
• Pedestrian Campuses - Those where the majority of students come from areas beyond
the surrounding communities and live in student housing near campus. While students
may or may not have cars, campus facilities, programs, and activities are structured to
enable and to encourage students to walk to campus.
The vast majority of higher education institutions, whether commuter or pedestrian in nature,
make a concerted effort in their master planning to hold parking to the periphery of the campus
as much as possible. The objective is to encourage those who drive to park once and then walk
between classes and other campus activities. A relevant distinction between the two categories is
the ability of a pedestrian campus to structure things so that many students will view walking,
rather than driving, to campus and from location to location on campus as the preferred option.
Ricks College is a pedestrian campus. Most students (even most who own cars) walk to campus.
Of those who drive, the majority park in one place and walk between classes and other campus
activities. Very few students make the ineffective attempt to drive between classes.
With many thousands of pedestrians steadily crisscrossing campus on a daily basis, pedestrian
safety is, and must remain, a paramount concern. Therefore, the college is committed to holding
vehicular traffic to the periphery of campus to the greatest extent possible. Be assured that the
campus master plan, which is currently being revised, reserves a peripheral corridor of land that
will allow us to meet the future parking needs of the campus.
With the transition to Brigham Young University -Idaho, it is anticipated that changes in parking
patterns will emerge. However, we are confident that using a city ordinance -based formula to
determine the extent or location of college parking will not effectively serve the overall concerns
of either the college or the city. Nor will a review of historical patterns of the past correctly
anticipate future needs.
Accordingly, this fall we propose initiating an ongoing study of student -related parking pressures
and practices. We view this type of study to be the appropriate method to guide us as we move
forward. This study will be updated multiple times per year over at least the next six years and
will address Saturday and Sunday usage as well as that experienced on weekdays. Throughout
the course of this study, findings will be shared with city officials.
In light of the above information, we respectfully request that the city revise its current ordinance
to accommodate the use of ongoing statistical data and campus master planning methods in
guiding decisions related to college building permit requests. We further petition the city to
expeditiously grant needed variances, if applicable, to existing ordinances with regard to the
building permit application for the replacement of the Jacob Spori Building so that this project
can move forward in a timely manner.
Please know of our sincere gratitude to the citizens and leaders of Rexburg for a wide range of
support extended to Ricks College. The ability of the college to meet its mission over the years
has been possible in large degree because of the caliber of this community. We are confident this
will remain equally true as we become Brigham Young University -Idaho.
SECOND ADDENDUM TO APPLICATION FOR
CONDITIONAL -USE PERMIT
Ricks College respectfully submits the following second addendum to its application for
conditional -use permit to construct the Spori Building. This addendum is based on previous
public hearings and continued discussions between Ricks College and the City of Rexburg.
Ricks College, in conformity with the provisions and intent of the Rexburg Zoning Ordinance,
requests that the conditional -use permit be granted subject to the following conditions and
safeguards:
1. Commencing immediately, Ricks College will initiate a study of parking on
the Ricks College campus as described in its first addendum to the application for
conditional -use permit. Once the parameters of the study are defined, the College will
seek comments and suggestions from the City regarding the content and format of the
proposed study. It is the intent of the College to commence the study as soon as
practicable and complete the study by January 2002. Based on the results of the study
and other additional information received, the City and College may propose possible
amendments to the Rexburg Zoning Ordinance addressing concerns regarding campus
parking demands and uses. It is contemplated that proposals may include a revision of
the parking -density requirement contained in Section 5.8 of the Rexburg Zoning
Ordinance and/or the development of a parking overlay district pursuant to Chapter 5 of
the ordinance.
2. Ricks College will construct 150 additional parking spaces located on the
campus. Such parking facilities will satisfy all parking requirements associated with the
construction of the Spori Building. Construction of the parking shall be completed prior
to occupancy unless the College and City agree that a delay is warranted by reason of the
positive impact and reasonableness of including the parking into future planned parking
areas. Provided; in the event the City Council reduces parking -density requirements by
amendment to the Rexburg Zoning Ordinance prior to the issuing of an occupancy
permit, the number of parking spaces exceeding that required by any such amendment
will be attributed to other current and future parking requirements of the College.
Pursuant to direction received from the Planning and Zoning Commission, Ricks College
has opened a dialogue with the City to address parking issues relating to the construction of the
Spori Building as well as matters regarding ordinance changes and future parking issues. We
feel that the above proposal is responsive, not only to those discussions, but to all provisions of
the Zoning Ordinance and to the needs of the community and the College. As Ricks College
transitions to BYU—Idaho, the College desires to do so with the blessing and support of the
City -with a spirit of cooperation and mutual benefit.
It is the intent of the College to address and respond to factual concerns which the City
has regarding parking on the campus. However, in doing so, the College must not delegate or
relinquish its responsibility to plan the expansion and growth of BYU—Idaho in accordance with
the directions and mandates it has received from the Church. We call upon the City to recognize
this responsibility and support the College in its growth and future planning—including the
development of parking sites on campus that will serve College employees and students in an
efficient and useful manner. The College pledges its best efforts in continuing to plan future
expansion and change in a logical and community -friendly manner. During this time, we feel it
not only important but a necessity to keep the lines of communication open with the City as to
future plans and growth.
During this time of transition, Ricks College remains deeply committed to developing a
campus that will not only serve its students well, but will also be a wonderful asset and blessing
to the community.
