FINDINGS OF FACT
FOR
CONDITIONAL USE PERMIT FOR RICKS COLLEGE
On February 6, 2001, Jensen Haslem Architects presented to the Rexburg City Clerk a
Request and Application for Conditional Use Permit for property located in the City of
Rexburg, for the purpose of constructing a two story multi -use facility on the Ricks
College Campus at approximately 200 Kimball.
2. On February 14, 2001, Lanny Herron representing Jensen Haslem Architects and Dave
Waldron representing Great Basin Engineering appeared before the Planning & Zoning
Commission for the City of Rexburg requesting a conditional use permit for the
construction of a 10,000 square foot two story multi -use facility on the Ricks College
Campus. There was lengthy discussion concerning the number of parking spaces (316)
provided for this facility and it was determined by Planning & Zoning the parking was
inadequate. It was requested that additional parking be provided for this facility then
recommended it be sent to public hearing showing the plans for additional parking.
3. On February 15, 2001, the City Clerk sent the Notice of Public Hearing to be published
in the local newspaper on February 16 and February 28, 2001, posted a notice on the
property and sent notices to all property owners within 300 feet of the above mentioned
property.
4. On March 6, 2001, Lanny Herron, representing Jensen Haslem Architects on behalf of
Ricks College appeared before the Planning & Zoning Commission for the City of
Rexburg requesting a Conditional Use Permit for a 10,000 square foot, two story multi-
use facility with 381 parking spaces on Ricks College Campus. There was no public
comment. It was recommended by Planning & Zoning that this request be approved for
public hearing before the City Council.
5. On March 7, 2001, Lanny Herron from the firm of Jensen Haslem Architects appeared
before the City Council of the City of Rexburg on behalf of Ricks College, requesting
approval for the 10,000 square foot two-story multi -use facility to be built on Ricks
College campus. There was discussion concerning the use of the road called Kimball
Alley and emergency vehicle access. It was moved the Council take the recommendation
of Planning & Zoning and approve the Conditional Use Permit for the multi -use facility.

Bobbette made a motion to approve the minutes of January 24, seconded by LaDawn. All voted
aye, none opposed.
John Millar reviewed the procedures to be followed concerning conflicts of interest.
Updated maps of the Comprehensive Plan as approved by the Council two weeks ago were
distributed to the members. The new zoning map should be printed by the next Planning &
Zoning meeting.
Ted announced that next week will be the last week for Raymond Hill and he will be replaced by
Robert Schwartz.
Public Hearing for Norm Thompson Annexation
John Millar read the Notice of Public Hearing. He then explained the location of the property
and the positive position of the City with regards to this annexation and the HBD zoning.
Ted explained the procedure for the public hearing. Public hearing was open. There was no
public comment and the hearing was closed and turned to the Board for discussion.
Mike made a motion to approve for public hearing before the City Council the annexation of this
property and the Highway Business District zoning. Motion was seconded by Raymond. All
voted aye, none opposed.
The Hawkins Companies agenda item was cancelled by Hawkins and rescheduled for the
February 28 meeting.
Joe Allen Preliminary Plat and Site Approval
John Watson declared a conflict of interest and stepped away from the Board.
John Millar explained there are two separate issues, the site plan approval and the preliminary
plat on the property. Unless Joe starts selling property there is no reason for them to subdivide
this property. Once they divide this into 3 or more separate parcels then there has to be a
subdivision plat filed. As long as they are not actively marketing individual lots then the two
issues can run separately.
Kim Leavitt - Harper -Leavitt Engineering
Kim is representing Joe Allen in this proposal. He presented the preliminary plat for review to
the board and explained the location and description of the property in question. The plat, after
the right-of-way, is approximately 7 acres and the proposal is to have four lots. There was
discussion concerning setbacks and right of ways and departmental approval.
Mike made a motion to approve the preliminary plat on condition of City Departmental
approval. Motion was seconded by Doug. All voted aye, none opposed.
The proposal for the preliminary site plan was discussed which involves only Lot 1. The acres
on this lot have changed and are now 2.4 acres. There are two entrances onto Salem Highway, a
green scape and a 4'6" strip on the south. There was discussion of protecting neighbors,
discussion with neighbors that were in attendance, irrigation canal, curb and gutter.
Doug made a motion to approve this site plan, seconded by Bobbette. All voted aye, none
opposed.
Ricks College Conditional Use Permit
John explained the agreement the City has with the College that any building over 10,000 sq. ft.
would go through the process of a Conditional Use Permit. The departments have reviewed the
site plan and have found no major issues at this time, parking appears to be adequate for the
building and the storm runoff numbers are being reviewed.
Mike Thueson declared a perceived conflict of interest since he works at Ricks College.
However the conflict is only perceived and will have no bearing on his being able to review and
make a decision on this project.
Lanny Herrin - Logan, Utah, the architect and Dave Waldron - Ogden, Utah, the civil engineer,
representing Jensen Haslam Architects.
The building is a two story with partial basement of approximately 54,000 sq. ft. Dave gave an
explanation concerning the project. A portion of the Ricks College campus will be used for this
multi -use facility building, it will be used for Sunday worship services, a Stake Center, as well as

class rooms, faculty offices and some intramural activities. Expected uses will range from
overflow for congregations to basketball. Looking at the facility based on it being a "worship
facility" they have determined the parking requirements to be 310 stalls and this plan provides
316. In addition to parking, they have tried to establish a good deal of landscaping on the site
itself. As a very minimum there is 20 feet around all the developed areas that will receive
landscaping in addition to several large tracts that will help to make this a good entrance feature
to the college. The calculations for storm water are based on 100 year storm water retention
with a release rate of 0.19 cu. ft. per second per acre so it should have less of an impact than what
is existing at this point in time. Utility wise they are working with the college to bring in
additional utilities that will service this building.
Discussion on the criteria used for arriving at 316 parking spaces. Dave explained they looked
at the available seating in the chapel as well as the cultural hall, the City ordinance requires 1
parking stall for 4 seats. This total number was taken divided by 4, arriving at 310 stalls. There
was lengthy discussion concerning the parking, use of the building, the number of stalls actually
needed when the building is at full capacity, the possible use of the parking lot for the Kimball
Building which has 200 stalls, the alley between the two buildings to access the other parking
lot, the potential number of cars at full capacity, the problem with parking on the entire campus
as well as the college housing complexes and other matters concerning the need for more
parking with this facility.
John Watson made a motion to go to public hearing on the condition the plans come back with a
solution for more parking meeting a larger capacity use of the building. Motion was seconded
by Bobbette. All voted aye, none opposed.
Because of the time line of publication, meeting schedule and to facilitate the timing of this
project it was determined a special meeting would be held for the public hearing which would be
scheduled for Tuesday, March 6, 2001, at 7:00 p.m. This project could then appear before City
Council for approval at their regularly scheduled meeting on Wednesday, March 7.
Steve Oakey Site Plan Approval
John Watson declared a conflict of interest and stepped away from the Board.
Mike Thueson was excused for other commitments.
Johnnie Watson, representing JRW & Associates presented the site plan for the Steve Oakey car
wash at 50-60 So. V West. When this property was purchased there was an agreement with
Cottonwood Apartments that the back section of the lot would be used for their additional
parking. Between this project and the property owned by Vera Rish there is a 4' landscape space
and a 5' high vinyl fence to create a buffer zone, on the west side there is a fence adjacent to the
parking lot and on the north side between the existing parking lot there is a landscape area to
meet the 10% required landscape. The sanitary sewer from both properties will be used and the
existing water services since So. I' West has recently been rebuilt and they were instructed not

Mike Ricks made a motion to approve the minutes of February 28'. LaDawn Bratsman
seconded the motion. All voted in favor. None opposed.
Public Hearing - Ricks College Conditional Use Permit
In the absence of Stephen Zollinger, City Attorney, John Millar, P.F.C. read the Notice of Public
Hearing for Ricks College Conditional Use Permit. He explained that when the ordinance was
established it was agreed that Ricks College had a lot of small buildings that were internal to
Ricks College campus so it was decided that any building under 10,000 square feet would not
require a Conditional Use Permit but buildings over 10,000 square feet would require a
Conditional Use Permit. That does require one public hearing. Two weeks ago we met and
reviewed their plans. At that time we requested some justification and modification to the plans.
Those have been drawn up and submitted.
John Watson opened the hearing to public comment. There were no comments from the public
and John Watson closed the hearing to public comment and asked for a spokesman for Ricks
College to explain the changes they had made.
Lanny Herrin, Architect, said that since the last meeting they had met as architects with the
College and had agreed that 381 cars would be an acceptable number based on the occupancy of
the building. The occupancy was determined by looking at the Uniform Building Code. Also,
they widened both the north and south roadways.
Dave Waldron, Civil Engineer, explained they have widened the north approach and extended it
to the Kimball parking lot to provide better traffic flow. It is now 3-12 foot lanes plus curb and
gutter on each side so it is 41 feet wide. This allows for a left and right turn lane onto 2' East.
By the Kimball building there will be a small curb to direct traffic into the Kimball parking lot.
Emergency vehicles can still get over the curb going West. They have also widened the south
approach onto 2nd East to allow for stacking.
John Watson asked if they had utilized the compact car rule. Dave Waldron said that all parking
spots were for full sized cars. The minimum is 9x18, the spaces on this plan are all 9x20.
For clarification, John Watson explained the 2 ways of calculating the number of parking spots.
If you argue that this is a College there is 1 per 4 at maximum capacity. (pg 45 of Zoning Ord.)
In his opinion the word capacity should say occupancy because then that gives them some
criteria. The building code says that in a certain sized room your occupancy load may be 20
square feet per person so then there is a way of calculating. This building fits somewhere
between a College and a religious facility. If you say this is just a religious facility then it is 1
per 4ft or 8ft of bench in the main meeting room. They based this on capacity or occupancy load
and are going to put an occupancy load sign on the wall somewhere. John is comfortable with
that, and they have made a good effort.
Mike Thueson stated that he had a "perceived" conflict of interest, but moved that they approve
the new drawing with the 381 parking places and widened roadways as shown and send it to City
Council. Glenn Walker seconded the motion. All voted in favor. None opposed.
Green Valley, Inc. Request for a Parking Variance
John Millar explained that this is on the corner of 2' South and I' West across from the
stadium. One of the houses was moved out last Fall. It is probably not a variance that they need
but it needs to be determined if they fall under the grand father clause. In discussing this with
Stephen today, the properties that they had a vested interest in, (they purchased the property and
spent the money to take the house off), could be grand fathered. Additional properties
purchased after the ordinance was changed, not as clear. His feeling is maybe we need to be
somewhere in-between - maybe on a proportionate property basis.
Bill Follett, 1 North 3400 E., Rigby -
Over a year ago they were approached by the owner of the Breckenridge Apartments about doing
an addition to their existing facility. At that time he owned the existing apartments and 2 lots.
There are 2 additional lots that he purchased in August, the one across from the stadium where
they moved the house off the one behind it. In the summer they came up with a design that fit
with the code at Ricks College then they employed Mountain River Engineering to put together
a temporary plat. They submitted it to Val Christensen, Building Inspector, in August and Val
wrote them a letter saying it was looking good but there were some questions. He had also given
it to Dee Owens the fire inspector. They came back with a number of items that needed to be
addressed. They started working on these items and then got the notice in December that the
parking requirement had changed. This is something they have been working on for quite a

Donna asked for a correction on page 2 paragraph 3. Tru Value should be True Value. All

Conditional Use Permit - Ricks College Multi -Use Facility

They met with the Planning Commission over the last couple of weeks to review their
Conditional Use Permit for approval for a building over 10,000 square feet on campus. The
commission recommended approval last night for it to go before City Council.
John Millar explained that at the first meeting there were concerns over the number of parking
units that were presented and also the accesses of some of the parking lots on 2' East and
interior to the college. The Planning Commission made some recommendations. They followed
those recommendations and increased the parking from 316 to 381 which fully meets the
ordinance. The building will be posted for the capacity so it basically will limit the use of the
building to the parking spaces. The changes made on the two roads where it joins onto 2' East
were widened so there is a right turn and a left turn lane as they exit onto 2"' East. The road that
comes back to the interior of the campus (Kimball Alley) - they are looking at closing that off
just west of this building with a minor closure so it will direct traffic back along the west of the
radio station. The access will still be available through Kimball Alley but you will have to come
around through the parking lot and back around. For emergency vehicles, the curb across that
will be such that it can be crossed by emergency vehicles. With those changes Planning and
Zoning recommended that a Conditional Use Permit be issued.
Glen had some concern about the road called Kimball Alley. There was a reason that was
required, why are we now deciding we don't need it? John said when that was originally put in
there was interest in limiting the amount of traffic through there and it was put in from a
constrictive point, the road is quite narrow. The reason for that is to try to discourage vehicles
through there so it doesn't become a by pass road across town, this in essence doesn't close it, it
just requires that you take one more jog to get around it. Glen wanted to know how much time
Planning and Zoning spent looking at why we had that there and why we are now circumventing
what we had before. Donna said that Planning and Zoning brought that up, it is still open for
emergency vehicles but they don't really want it to become a thoroughfare because of the
pedestrian traffic.
Lanny said they have minimized the traffic patterns between the east entrance into the Kimball
parking lot and the west entrance into the Kimball parking lot on the south side so that you can't
go straight east, you have to go into the Kimball parking lot on the road that is there now and
back out. The area between is what they have limited to general traffic.
Paul asked if there was any consideration given to long trucks being able to negotiate the curves.
If we are successful in getting a ladder truck is it going to be able to make those turns. Lanny
said there is physically no change to the existing flow. The curb is only a 3-4 inch high curb so
any emergency vehicle can easily jump over that.
Donna made a motion that they approve the Conditional Use Permit for the Ricks College multi-
use facility. Marsha seconded the motion. All voted aye. None opposed.
Public Hearing - Norm Thompson -1450 Salem Road - Annexation and Zone Change
John Millar explained that the parcel being annexed is a one acre piece that the existing
Thompson building sits on located just south of the old Ultimate Direction building, now
Porters. We acquired some right -a -way from him and as part of that he requested annexation. It
has gone through Planning and Zoning, there was no public comment, they recommended it be
approved for annexation. It is being zoned BBD.
Glen asked if they were paying the sewer and water hook up fees. John said they actually
worked out an agreement with them. The City acquired quite a bit of right -a -way on the west
side of their property to widen the road. We worked out those fees and there is an agreement.
