S. 20. Yours truly, CITY OF REXBURG Marilyn Hansen FINDINGS OF FACT FOR ANNEXATION FOR SCOTT SPAULDING 1. On October 3, 2000, Scott Spaulding presented to the Rexburg City Clerk a Request and Application for Annexation for property located west of 1520 West and U. S. 20. bordered on the north by the Widdison Addition and on the south by storage units. 2. On October 11, 2000, Scott Spaulding appeared before the Planning & Zoning Commission for the City of Rexburg requesting annexation of property located west of 1520 West, which property is in the Impact Zone and is comprised of approximately 1I- 1/4 acres. The requested is to annex as residential, possibly LDRI with some MDR. There was some public comment with concerns of the traffic, new roads, access roads. It was approved for this annexation to go to public hearing. 3. The City Clerk published the Notice of Public Hearing in the local newspaper on October 30, and November 6, 2000, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 4. On November 15, 2000, Scott Spaulding appeared before the Planning & Zoning Commission for the City of Rexburg at a public hearing requesting annexation of property located west of 1520 West. It was requested that annexation be zoned partially LDRI and partially MDR. There was considerable public comment opposing any zoning of MDR which would allow for multi -family dwellings in terms of apartments. After discussion it was moved by the Commission that this matter go to City Council to be annexed with all zoning as LDRI. 5. Due to a technical problem in the process of this hearing it was concluded the last public hearing should be cancelled and the process would start from the beginning. 6. The City Clerk sent for publication the Notice of Public Hearing in the local newspaper on December 6 and December 13, 2000, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. On December 21, 2000, Scott Spaulding appeared before the Planning & Zoning Commission for the City of Rexburg requesting annexation and zone change of property located near U. S. 20 and west of 1520 West. The request for zone change is partially LDRI bordering the Widdison Addition and MDR on the southern portion. There was some public comment concerning the MDR zoning. A motion was made to recommend this annexation and zone change for public hearing before the City Council. 8. The City Clerk sent for publication the Notice of Public Hearing in the local newspaper on December 29, 2000 and January 10, 2001, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. On January 17, 2001, Steve Nielsen and John Dester appeared on behalf of Scott Spaulding before the City Council for the City of Rexburg requesting annexation and zone change for the property located near U. S. 20 and west for 1520 West. There was some public opposition concerning the zoning and the location of the MDR zone. After discussion it was recommended by motion that this annexation and zone change be approved as being in the best interest of the community as the plan is presented. � Q StephenlZollinger, City Atto y
