FINDINGS OF FACT
FOR
NEWPORT INVESTMENTS
On April 19, 2001, Newport Investments presented to the Rexburg City Clerk a Request
and Application for Zone Change on property located at 559 So. 4th West in the City of
Rexburg, said property to be changed from High Density Residential (HDR) to High
Density Residential 2 for the purpose of building married student housing.
2. On May 9, 2001, Newport Investments appeared before the Planning & Zoning
Commission for the City of Rexburg requesting a zone change of said property from
High Density Residential to High Density Residential 2 . It was recommended that this
request should go to public hearing.
3. On May 10, 2001, the City Clerk sent the Notice of Public Hearing for publication in the
local newspaper on May 14 and May 21, 2001, posted a notice on the property and sent
notices to all property owners within 300 feet of the above mentioned property.
4. On May 30, 2001, Keith Nellesen on behalf of Newport Investments appeared before the
Planning & Zoning Commission for the City of Rexburg requesting a zone change from
High Density Residential to High Density Residential 2 on property located at 559 So. 4'h
West. There was no opposition expressed concerning this zone change. It was
recommend by Planning & Zoning that this request be approved for public hearing before
the City Council.
On May 31, 2001, the City Clerk sent the Notice of Public Hearing for publication in the
local newspaper on June 1 and June 13, 2001, posted a notice on the property and sent
notices to all property owners within 300 feet of the above mentioned property.
6. On June 20, 2001, Keith Nellesen appeared before the City Council of the City of
Rexburg requesting a zone change on property located at 559 So. 4'h West to High
Density Residential 2 (HDR2). There was one voice of opposition to the zone change. It
was moved that the Council take the recommendation of Planning & Zoning, that the
proposed land was a good location for married student housing to accommodate Ricks
College increased enrollment and approve the requested zone change, .
