Center Rexburg, Idaho 83440 Dear Planning and Zoning Members: The article in the June 6th Rexburg Standard and Journal about the request from Dr. Gary Lovell to change the zoning of three lots, one being 45 South 200 East, to commercial is of great concern to my mother, Hazel Willmore, who owns that property. Dr. Gary Lovell does not own the property or have any intention of buying the property at this time. On May 14th his real estate agent told mother that the zoning change was "a done deal" and that if she did not accept his last offer of $25,000 less than her asking price, Dr. Lovell would go ahead with the plans he had for the adjacent properties and she would be left "holding the bag." Fearing for the loss of the value of her home if it were the only residential unit in a commercial area, she signed the agreement. Unbeknownst to her, two other parties were seriously interested in her property at that time. After those two parties had purchased other properties, Dr. Lovell used the pretext that he could not get funding to buy the property to get out of the purchase agreement. He informed mother of this Tuesday, June 5th, only ten days before closing. If this property is zoned commercial, it will increase property taxes and decrease mother's chances of selling her home for a fair price. She is counting on this income to help her remain independent and reside in a retirement center for her remaining years. It will also give Dr. Gary Lovell an opportunity to come back at a later date and try to purchase the home and property for an even lower amount than he offered in the beginning. In all fairness to my mother and because Dr. Gary Lovell does not own this property or have a purchase agreement to buy this property, I, as having power of attorney for my mother, request that her home and lot be removed from this request for change of zoning to commercial. Your forthright consideration in this matter will be greatly appreciated. There have been many rumors of people selling their homes and others backing out of sales. I neither come here tonight to protest or approve the proposal but, I am here to hear all of the testimonies both for and against. Therefore I hereby recommend tabling the proposal for two weeks which will give the people with the most concern time to discuss and make decisions on this zoning change.
