FINDINGS OF FACT
FOR
ZONE CHANGE FOR GARY LOVELL
1. On May 23, 2001, Gary Lovell presented to the Rexburg City Clerk a Request and
Application for Zone Change on property located at 45 So, 2nd East, 35 So. 2°d East and
228 E. Main in the City of Rexburg, said property to be changed from LDR 1 to LDRI
with a Professional Overlay for the purpose of additional parking and/or professional
offices.
2. On May 30, 2001, Gary Lovell appeared before the Planning & Zoning Commission for
the City of Rexburg requesting zone change of said property from LDRI to LDRI with a
Professional Overlay. After discussion it was recommended that this request should
include additional property from the present LDRI/PO to 2' East and be recommended
to go to public hearing.
3. On June 14, 2001, the City Clerk sent the Notice of Public Hearing for publication in
the local newspaper on June 20 and July 2, 2001, posted a notice on the property and
sent notices to all property owners within 300 feet of the above mentioned property.
4. On July 11, 2001, Gary Lovell appeared before the Planning & Zoning Commission for
the City of Rexburg requesting a zone change from LDRI (Low Density Residential 1) to
LDRI/PO (Low Density Residential 1 with a Professional Overlay) on property
described as those portions of Lots 1, 2, 7 & 8 that lie west of "The Professional Plaza"
in Block 1 of the Rigby Addition to the City of Rexburg. There were several objections
from neighbors to the zone change. After a lengthy discussion concerning a larger portion
of this area it was recommended that this request be tabled for further review by the
Planning & Zoning Commission for a more comprehensive professional overlay zone.
