Yours truly, CITY OF REXBURG Marilyn Wasden City Clerk FINDINGS OF FACT FOR LDS CHURCH VACATING ALLEY AT 4TH -15TH WARD CHURCH 1. On October 9, 2001, John Watson, President of JRW & Associates and on behalf of the LDS Church presented to the Rexburg City Clerk a request to vacate a portion of the alley which alley is enclosed within the property owned by the LDS Church and known as the 4th -15th Ward Church in the City of Rexburg. 2. On October 24, 2001, John Watson on behalf of the LDS Church appeared before the Planning & Zoning Commission for the City of Rexburg requesting to vacate a portion of the alley enclosed within the 4th -15th Ward LDS Church property. It was recommended by the Planning & Zoning Commission that this request go to City Council for public hearing. 3. On October 31, 2001, the City Clerk sent the Notice of Public Hearing advertising a public hearing before the City Council on November 21, 2001, for publication in the local newspaper on November 7 and 14, 2001, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 4. On November 21, 2001, John Millar on behalf of JRW & Associates who represent the LDS Church appeared before the City Council for the City of Rexburg requesting to vacate a portion of the alley at the 4th -15th Ward LDS Church. There was some public comment in favor of vacating the alley. It was recommended by the City Council to vacate the said alley as requested. Stephen Zollinger, City A rney
