These are listed in the Zoning Ordinance for each zone. The City Clerk or City engineer should be consulted if you have questions about whether your proposal will need a Conditional Use Permit. If a C.U.P. is needed, you will need to get an application from the City. Clerk and fill it out for a C.U.P. You will then need to return the application and request that the City Clerk put you on the Planning Commission agenda one week prior to the meeting. The Planning & Zoning Meetings are held on the 2"' and 4te Wednesday of every month at 7:00 p.m. The City Clerk will then mail to the Planning Commission the application for them to review prior to the meeting. At the meeting the board will discuss your request with you and set it for Public Hearing. You will need to pay $200.00 to the City Clerk prior to any advertising for the hearing. Prior to granting a conditional use, at least one Public Hearing shall be held to give persons an opportunity to be heard. The City Clerk will put the notice for the hearing in the paper 15 days prior to each hearing, mail a copy to all the property owners within 300 feet and post a notice on the property. After the Planning Board holds their hearing they will make a recommendation to the City Council. The City Council will take the Planning Board recommendation into consideration. If a hearing is required before the City Council they will then take into consideration oral and written testimony as well as the recommendation from the Planning Board. Dennis came in and the following was concluded. Dennis had appeared before Planning & Zoning on October 14, 1999, where he was granted a Conditional Use Permit to build approximately fourteen (14) storage units on his property at 115 So. 2' West. A building permit was obtained for this project on November 13, 2000, this project was already underway at that time, Darin Davies being the contractor. At the time of granting the permit a framing inspection was requested which was done on November 13, 2000. No other inspections were ever called for. Marilyn and Val both attempted to contact Dennis without success. On April 2, 2001, Val contacted Dennis, 10 new storage units had been built with no building permit nor had they been before Planning & Zoning. The units were complete and full. When an additional 18 units were being built the Stop Work Order was issued, thus Dennis coming into the office. Val, John and Marilyn reviewed the file, Dennis was called, he came in after the Stop Work Order, and picked up the papers for a building permit. Building continued on that date, they were hanging doors, Marilyn called Dennis and told him that a Stop Work Order, meant to stop work. Later in the day Dennis returned the building permit and the file was reviewed with him concerning the violation of the Conditional Use Permit. He was told we would have to talk with Stephen before anything further could continue. April 24, 2001, Stephen, John and Marilyn reviewed the situation. Dennis came in and met with Stephen. The new 18 units have been nearly completed and are all rented to college students, there is only one week left before school is out and not completing these units would put the students at a loss as to storage. Stephen gave permission to Dennis to finish the units for the students BUT he needed to begin the process of a Conditional Use Permit for the additional 28 units which had been built. If this was granted he would need a building permit for the entire 28 units immediately. If the Conditional Use Permit is not granted, the units would be closed down and used only for personal storage. Dennis agreed he would return the Conditional Use Permit Application the afternoon of April 24.
