CONDITIONAL USE PERMIT FOR RICHARD BALLOU
On February 27, 2001, Richard Ballou presented to the Rexburg City Clerk a Request and
Application for Conditional Use Permit on property located at 61 Ponderosa, in the City
of Rexburg, for the purpose of having an apartment attached to said home.
2. On March 14, 2001, Richard Ballou appeared before the Planning & Zoning Commission
for the City of Rexburg requesting a Conditional Use Permit for an apartment to be
attached to the rear of said home at 61 Ponderosa. It was recommended that this request
should go to public hearing.
3. On March 19, 2001, the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper on March 23 and April 4, 2001, posted a notice on the property and
sent notices to all property owners within 300 feet of the above mentioned property.
4. On March 26, 2001, Rich Ballou telephoned the City Clerk and stated that he had had
several conversations with a neighbor and the neighbor was unwilling to agree to this
Conditional Use Permit and because Mr. Ballou does not desire to have an uprising in the
neighborhood he was withdrawing his request for a Conditional Use Permit and would
build his home elsewhere.
On March 27, 2001, the City Clerk caused said Notice of Public Hearing to be withdrawn
from publication on April 4, 2001. The cost of the publication for March 23 was $50.58,
which was deducted from the $200.00 fee and the amount of $149.42 was refunded to
Rich Ballou.
