The following words and plirases when used in this ordinance shall have the meaning set ❑tit in
this Secfion:

1 5) Public Rights -of' way: Improved or unimproved public property owned by, dedicated to, or
deeded to the public or for the public's use, for the purpose of providing vehicular, pedestrian
and other public use. Such public property provides cire''u.1ation and travel to abutting
properties and includes, but is not limited to, streets, side'w'alks ���dscaping, .17provisions for
public utilities, cut and fill slopes, and open public sp-a-ct!,-. For the. Purpose -s of this Chapter,
alleys are excluded from this definition..

resulting from tree conditions and/or failUres while using Public Property..

1 7) Public Nuisance: Any tree or part thereof (public or private.) which, by reason of location or
condition, constitutes a hazard to pUblic safety.
1 S Public Trees: Any tree (inclusive of roots within the critical root zone) whose trunk is
located, partly or in whole, on public property,.
19) Topping: "Rounding" or "heading back" or any other term that can be deScI1bed as severe
cutting back of timbs widiin a tree crown to buds, stubs, or laterals not large enough to
assume a terminal role or as defined in ANSI A300.

8.08.020 Applicability
This Chapter establishes regulations and standards necessary to ensure that the City continues to
realize the benefits provided by the Community Forest. It is not 'intended to resolve or regulate
disputes over trees on private property that do not affect general public safety. This ordinance is
enacted to :

4} Encourage site and utility planning, building, and developillelitP ractices to prevent
indiscriminate removal or destruction of trees and avoid unnecessary disturbance to trees
within the City and its Area of Impact;
S) Maintain trees in a healthy, non -hazardous condition through application of trey care
standards contained in ANSI A30041
6} Establish and maintain appropr.6 iate species diversi'ty and age classes in order to provide a
stable and sustainable community forest;
7) Establish a pra+ccss by which pUbhoc trees are to be pla-wed., pruned and rcmoWed;
$) Implement the foals and objectives of the City's Comprehens'D

8.08.030 Jurisdictioll

1) Public Propeilv: The City Tree Commission shall manage and regulate the planting,
maintenance, protection, removal and replacemetat of all public trees within the City limits*
thus eXeCL'1sIP"!g the, City's authority to coo so granted pursuant to the provisions of Idaho Cade
SQ -312 - Improvements of Streets, Idaho fade 50-317 - Removal of snow, ice rubbish and
weeds, Idaho Cade X415 (7) RespQnsibilitles of Single county -wide highway districts withtn
cities — Final decision on urban renewal projects — Settlement of uestiolls.

public rights of way so cleared, as provided for in Idaho Cade 50-317. The assessment shall
be collected as provided in Idaho Cede 50-1008.
3) Area of Impact: The City Tree Comm -ss- shad tnal�e recommendations with respect to
tees that are of general public interest within the Imp -act area. Such general public interest
shall include,, but not be limited to, frees that will impact visually the public :rights of way,
a,
trees that overhang public owned properties., and trees that are of such a nature as to have
significant public recognition. (Ord. 919 §3, 2004).

e) maintain a Community Forestry budget to be contained within the budged of the Gita,
Tho CitvR.

upon determination by the City Tree. Commission, pose a threat to public trees.
iv) Removal of all debris (wood, branches & leaves} froni public properly by sunset of
the day on which any tree work is dons. (Ord. 919 §S, 2U04).

8.08.060 Permits
�} No person may perform any of the following acts without first obtaining from teteCity Tree
Commission a pert��it fir which no fee shall be charaed, and nothingin this section shall be
construed to exempt any person from the requirements of obtaining any additional M1,11ts as
required by law:

3) Permit Application Pracedures
a) Contact the City Tree Commission via
mail, phone, fax or email prior to comm�encementof the proposed work.10
b) Upon inspection, the City Tree Commission may issue a permit to perform any of the acts
specified in part A of this section.

The City Tree Commission may condition the approval of anv permit.
4) Public Tree Planting Permits — .Requirements
a) Each. application for a planting pernalt shall designate the species and variety of public
tree proposed. The City Tree Commission shall designate the Iocatitin of the planting.,

tree species, spacing, placement and mininium tree well sizes shall be
obtained from the City Tree Gvmmission4P9W, prior to issuance of a permit -

the same. Thee cost of removal of such tree may be charged to person responsible for the.

5) Tree Pruning/Removal Permits — Requirements
a), Prior to pruning or removal of any public tree, application for permzt must be made by
the property owner or private tree firm currently licensed by the City,

of a misdemeanor under the provisions of this ���a�te� may be punished by a fine not to
exceed $300 or be imprisoned in the County Jail facility for a period not to exceed 6 months
or bv both such fine and imprisonment,

8.08*080 Public nuisances
The following are hereby declared public nuisances under this Ch, apter.
1) Any tree, shrub or plant or part thereof (public or private) which, by i•eason of location or
condition, constitutes a hazard to public safety as determined by the City Tz'�e Commission.
2} Any tree, shrub or plant or pari thereof ion public or private property) which obstruds the
free passage of pedestrian or vehicular traffic uon public n'.hts of- uvay or ruhich obstructs
pubfic street lighting.
3) Any trey, shrub., plant or alternate hash plant or part thereof (tin public or private property)
which harbors pests whicl7 reasonably izi.ay be expected to injure or harm, public trees. (Ord.
10;
9,19 §85 2004).
8.08.x}90 Abatement of public nuisances
The following are the prescribed meas of abating public nuisances under this Chapter:
1) Any free, shrub, plant or alternate host plant or part thereof (public or private) declared to be
a public nuisance shall be pruned, removed or othei-wise treated in accordance with the
requirements of this Chapter. Except for removal of'trees from public rights-of-way, all costs
for nuisance abatement are the responsibility of the adjacent property owner.
2) The City Tree Commission may cause a written notice to be personally served or scnt by
maid to the owner of a particular property declaring the existence of a nuisance, and the
means by which abatement maybe accomplished.
3) Inthe event the nuisance is not abated by the date specified in the notice, the pity Tree
Commission is authorized to cause the abatement of said nuisance. The reasonable cost of
such abatement may be eharged to the subject property owner. Monies which have not been
recovered through the City bill collection procedures tnay result in a lien against the property
or assessed on taffies as provided for in Idaho Code Title SD. In addition, the owner of the
property upon which the nuisance is located may be subject to prosecution under this
chapter, or any other Chapter of the City Code or the Idaho Code for Ynaintaini��
nuisance. Nothingprov]a publicin this ion shall construed to any person gainthe
requirement of obtaining perinisis.

4} The City Tree Commission is empowered to cause the immediate abatement of any nuisance
if it is determined by the Citi! Tree Commission to be an -emergency or posy an immediate
hazard to public safety. .

8.08.100 Appeals
1 ) Any person affected by an order, grani, denial, or revocation of a license or permit by the

date of notification of the decision of the City Tree Conimission.
3) The appeal shall be heard by the City Council within 30 days of the appeal being filed, and
any action by the City Tree Commission and the appellant shall he delayed until the decision
of the City Council is rendered_
4) The City council may in conformity with the prov"
sions of this Chapter reverse or affirm or
modify wholly or partly., the arder, gran
t. denial or revocation of any permit and the decision
of the City Tree Commission.
5} The decision ofthe C*tY Council shad be deemed final. (0 -rd. 9-19 § 10, 2004).
8s,08*110 Severability
The provisions of this Chapter shat[ be deemed severable and a finding by a court oflaw that a
provision of this Chapter is unlawful shall have no effect on the remaining provisions. Gard. 919

During an Audit of the Building permits,, there was an effor discovered in the square footage that
was calculated for Cougar Court Apartments. 720 square feed per apartment would calculate the
total square feet to 103,680 square feet. This is for b buildings with.24 units in each building.
The attached Building Permit Valuation Fee calcul ion sheet has been recalculated. Please
forward the total amount of $1.35",614..85 less the amount paid 11-07-2002,
The balance due is $115,833,27.
