TQM Consulting is notifying the City of Rexburg of a non-compliance item for the BYU Idaho Student Family
Housing Project. On February 6�', 20041 R. E. Beck Construction placed concrete for a window opening on
the south wain of Building #15: Apartment C1, that had to be repaired. Because it was a repair the sub-
contractor was responsible for heating and covering the placed concrete. At approximately 4:00 pm that day
T2 Consulting checker the cvnerete temperature of the concrete and it was 30° F, the air temperature was
30° F. The area had not been covered or heated. TQM Consulting then placed a High/Low Thermometer an
tap of the existing concrete adjacent to the fresh concrete and between the forms. T2M Consulting Ieft the
area at approximately 4:45 pm. The following morning on February 7th, 2004, at approximately 9;00 am T2M
Consulting arrived to check the High/Low Thermometer. The repaired window area had been covered with
insulated blankets, but there were no heaters or other equiprnent for heating. Upon checking the above
mentioned thermometer T2M. Consulting found the high to be 66° F, and the [ow to be 22° F. The
temperature of the concrete was 28° F.
There is no Possible way the concrete could have generated such heat without an external source. The
thermometer was immediately taken back to the lab and the calibration checked, and was found to be in
proper calibration. It is our conclusion that the sub -contractor, R.E. Becky attempted to falsify inspection
documentation and testrtg result by tampering with the High/Low thermometer, which makes them non-
compliant with the codes and standards for concrete and ethical conduct by the American Concrete InstUe
and the Internationai Code council.
T2M Consulting is aware of its responsibility to document and notify the Building Official, the American
Concrete Institute, the International Code Council, and the Idaho Building Officials Association of such
conduct. However we would appreciate any recommendations on how far and at what level this item of non-
compliance should be taken.
T2M Consulting finds this conduct unacceptable. As you. well know, as a special inspection and testing
company we must have the confidence and belief in the contractors ethics and professionalism to cooperate
with special inspection and testing procedures and the trust in knowing that any such contractor will never
impede or alter 'inspection documentation or testing results. We regrettably feel that this confidence and
trust i1a5 been lost. We WDUCd appreciate It, if the City of Rexburg Building Department would respond etcher
by mail or phone to this fetter of non-compliance, Thank you for your time and consideration.

I received your Architect's Supplemental Instruction No --. ASI- 16, dated 22
August 20Q3 (copy attached). The configuration of the brick portion on the fence
combined with the location will creme a sightImped' nent for traffic bath entering and
leaving the complex. If it was constructed so that you could see through it thin it would
meet our requirements. Our zoning ordinance will allow a maximum 3' high fence
within the first 15' from the right-of-way. The fence mai be higher if it is built iu a
manner to be 50% open. Your pian also identifies a concrete walk at the edge of the
road.. There must be a miinimum,T' landscape strip between the curb and the sidewalk. If

This letter is in response to RFI #3b received in this office 12 August 20a3 for the above
referenced project. I spoke with Val Christensen via telephone 13 August 20Q3 to clarify
his interpretation of the hallway dUCt/jOiSt issue referenced in RFI #36. He indicated that
because we provided for full sprinkler throucyliout the building, the rating dor our
condition at the hallway duct is only required to be ;�z-hour. The fire ass: niblv referred to
by.Louisiana Paci fi c (LPI) is for a l-hoLir condition. Thus, we are not requrcd to fol tow
LPI's detail for a I -hour rating. However, fire blocking must be installed at the plane of
the ftirr-down at the partition walls.
I placed calls to the representative for Louisiana Pacific, Mike Lamere on August 13 and
again on the 14�h, bath times leavincy void �nessa�es asking for a return salt. At the time
this letter is issued,. I have yet to hear back from that office,
Without a response from Louisiana Pacific'. and actino on the indication by the cage
official and our review of the cede requirements that the condition referenced above does
_ meet fire code requirements. it is our detem-iination. that we have mei the cads
requirement and likewise, any warrantee issues for engineered products should be valid
concerning the issue in question. f

This letter is in reference to the furnace rooms for the BYU4daho Married
Housing units where beth furnaces and water heaters are in one room and serving 2 unifs.
There is a requirement that requires a fire rated separation between apartment units and
with the 2 mechanical rooms combined a third fire gated separation area is created and
must be maintained With the other 2 units. This cremes several problem areas that were
identified, I believe, in the plan review. After researching the situation I have found that
the plastic piping requires fire projection with something like Intumescent Fere Tape or
Fire Stopeollars. I belimeve that this is being done.
The main problem is with the townhouse furnace room ducting, and svmewhtie
apartment units also, and mainly rests an IMC section 607.5.3 and IBS section 715.5.4
{which are both the same}. Duct penetrations ire fire partitions shall be projected with
approved fire dampers with 2 exceptions noted. Exception"i". Does not pertain, and
exception "2" which has 6 parts 1.1'sted below that reqw"re all pix be complied With:
In 2. 1. all the ducts shall not exceed the 100 square inch maximum. The supply
and return ducts installed are all over this limit. This applies to the C and D its also.
In 2.2 I believe complies bud have not confirmed t1�e 2 5 gage construction.
In 2.3 there shad be no openings that communicate with adjacent spaces. The
holy in the duct to heat the furnace room and the flexible connection do not comply with
this exception. This one also applies to the C and D uni-ts with the hole in the ducking.
2.4 Requires that the ducting be installed above the ceiling and in this case I
believe the supply ducts da comply except for the return air ducts that terminate at the
rated wall of each floor.

which both of the return dusts do terini'nate at the rated wall with registers in the wall.
In 2.6, which is new and in the 2000 IBS and IMC supplement says there will be
a sleeve installed around the duct. I have not seen any sleeves around these ducts.
This shaves that out of the 6 parts of the exceptions only one complies and it takes
only I non-cvmiAiance to rule out the use of this exception.
Dampers must be used in the ducting as everything now stands. There are other
options such as separat"Ing the 2 famace areas with a fire rated wall and nth rated doors
for each. This would then remove the required rating for the furnace room and put each
mechanical raven with each unit. I am sure there are other options that would sats this
situation and would look at any options you might have.

RE: Benson Building - Skybridge
Dear Lloyd,
At your request I performed a welding inspection/observation on the already completed Skybridge in the
new section of the Benson Building from grid line 2.0 t0 3.0 and from G.9 to the exiling buil-ding. All phases
of the construction for this item could not be observed but approximately 90 °Io of the bolting and welding
could be seen. After reviewing the plans, the general contractors daily reports, and the completed ►n►arkr it is
T2M Consulting opinion that all work performed is in compliance with flans, specifications,, and applicable
building codes. However this observation in no way creates liability for T2M Consulting, nor does it relieve
the Independent Testing Agency responsible for the project 'inspection and the contractor who performed
the work, of their liability for the Benson Building Skybridge being an accepted structural item.

1 missed you an Friday afternoon., I wanted to make sure that you understood that we

could not get all of your comments incorporated into the pians and specs. for the 13YU-1
Student ramllv Housing v6iect before we had to be out for bids. Just after the first of the
year we will begin putting together addendums for the revisions that need to be made.
Those addendums will take care of the comments from you and Chris Huskinson.
Please note that the structural calculations are based on an 80 mph wind load, When our
structural engineer came on board, the 90 mph that we were using caused some flags to
be raised on his part. He talked to a Blair Kay and received the 80 mph wind loading
requirement.
Please destroy the secs of plans and specs that you used for your review and utilize the
ones that I delivered last Friday for the construction phase of the project. Again, the
addenda that ars issued in early January 2003 will take Dare of the issues that were
raised by you and Chris.
Thanks for your cooperation in these matters.
