needs of the City, the developer, and Walgreen. He has beard. positive comments

and. amenities of the development have been discussed. Bob reviewed parking.,

Northwest for Walgreen. She was aware of the concerns of some people w*th the
positioning of the building on the proposed site after 1\4r. Tom 14-Lidson's review of the
downtown area.. the presented soarxa.e concerns that Walgreen has with tile positionincy
of the building. Walgreen. started as a Companyin 19Q1; so, they have been arocind
for over l 0:0 years. She rE:vi ewed the shoppers "self serve" concept that is the cunient
trend for shoppears, r:I'heir coz-i)orate strategy is to be the nation's most convenientand
techn.o Io gi c ally advanced drugstore. They want to be convenient by bel, jig loe'ated on

research proj*ects through "G.Rmore Research"' out of Seattle. Co-nvenience and safety
wire the two main cousiderations for the customers who were interviewed. in -the
Portland sUrvCys. They wanted to park close to the store. Women did not want to
park i.n a back parking lot at night. Thirty percent of their business is done. at nxght.

Council Member JEricksnn mentioned that the Council does not show the sarne
worrIes that have been expressed. This project 'is one of the best downtown prodects
be has seen in the last thirty-eight years of his Rexburg experience. "Same of us
share a more optimistic view than others." He recommended that they proceed with,
the application process through ibe Planning and Zoning Commission.
Josh Donat asked about the setback for the building and hove that will affect their
project due to the fact that the downtown area is a 25 mph street. He noted that one

Council Member Pugmiz-e asked pity Attorney Zollinger how tof`orin a motion to
include oatstandl'ng items with the project approval.
City Attorney Zollinger indicated that the project is approved with respect to all
elements except for signage, lighting, trees, street amenities, and bike racks which should
be conditioned in the motion. A_n example would be to say: conditioned upon the
-following -five itemsbcilia approved and completed within six Months. These five issue's
need to 'be clarified and approved withn'ew standards.
Roy Wiliiarns indacated that t4ey need to kraow which [�`xty body wl'll be worki" ng oil the
design i,-eqwrements for -those five issues.
Mayor Larsen indicatedthat thePlanning groupstart�rig with the Design Review Board
would work on starting the process. The PlanxZi.xag and Zoning Commission would make
a recommendati.011 to City CoUxacx1 after hearing the Design Review Board.

Council Member Pugmire rnoved, that we approve the site plan four Walgreens
development at Main Street and 2`1 Fast contin�ent upon the subsequent approval of the
open questions relative to trees, bike racks fences, lights, signacye, and other street
amenities brought to us by the Planning and Zoning that I failed to menfi'on; Council
Member Young seconded the motion; all vote aye, none opposed.

Mayor Larsen referred to the pubhc hearing on the land exchange on M:arch 1 6"", 20050
He asked. Bob Sherry io show floc land exchange on the overhead screen.
He asked if fllere was anyone that wanted to speak to the land exchange that did not get
the opportuni'ty on March 16"', 2005. Bob reviewed the properties that would lie
exchaiio-ed between his Company, the City of Rexburg and Madison County. The portion
o the new alley directly behind the proposed building will be forty feel wide.
The Couniy agreed. io theirportion of the land exchange in Febi-uary. Now Olt is the pity's
tum to approve their portion of t11e land exchange agreement.
City Attorney Zollinger indicated that the l.axad exchange was not a vacation of City
property. It 'is an equal exchange of squire footage.
'Bob Sherry mentioned that they will engage 1.11e City Council in the agreement. The
Attomey fxQzla..Phillips Edison &Company will lead in the fartuatzoxa. of the lanci
e-xcliange agreement with cooperative help from City Attorney Zollinger.

Council Member Pugmire explained that BILL 937 for the Arts has great ffitLxre
importance for the City. He expressed gratitude for the input that he received from- many
individuals concerning the Arts BILL. Around the nation, there are about 70% of Cities
and States that are constant 'in the application of the Arts policy and about 30% of the
i Itl1ecities adapt their policy to fit the needs of the local comi-nu-nity. Th*s BILL w'11 allow
City to Uui1d on a great tradition of Art (Culture and herXtage} in- our Community for the
future of Rexburg. Council -Meniber Pugm�re is very glad to sponsor this RILL and he
urged adopfion of the BILL 937. 11e explained that there were, two people present at the
meeting to support the BILL.
Mayor Larsen I'Dtroduced Jeannie Anderson as the Commissioner on, the Idaho
Can-11nission on the Arts. She is located in �L)riggs, Idaho. Slee was supportive and
applauded Council Member: Pugmire for presenting th.is BILL io the Council. The Idaho
Commission on the Ails Ilan as "Its Mission to being Art to all of Idaho.
