Plan Amend.September 20, 2000 Mr. Gary Archibald 1690 South 1000 West Rexburg, Idaho 83440 RE: Annexation Agreement for Central Park Restaurant Dear Gary, Returned herewith is your copy of the signed Annexation Agreement for the Central Park Restaurant. Your reimbursement to the City for the watermain, sanitary sewer, storm drain and street improvements along 2nd East St. (St. Hwy. 33) was due and payable to the City upon annexation. This is the $6,599.03 figure set forth on Page 14 of the Annexation Agreement. Note that these values were based upon the 124.51 ft. of width of the property left after the north half - street right-of-way width for 1000 North St. had been deducted from the original depth of the property. The $10.00/ lineal foot figure used for the watermain, sanitary sewer and storm drain pipes was a dollar figure adopted by the City Council several years that was supposed to represent one-half the cost of an 8" watermain, or sewer line; however, as you can see on pg 12, the estimated cost of water and sewer lines is now somewhat more than the $20.00/ lineal foot that these estimates were originally based on. The Contractor on the job (Zollinger Construction) was working for you; even though some of the work he did is work that the City is reimbursing you for (for example, Items 1,2 & 3 on pg. 12 of the Annexation Agreement). The cost of the construction of the street on 1000 North St. was partly your responsibility and partly the city's. You are responsible for one-half the Business St. (Typical Section # 4) as described and shown in the Annexation Agreement. The City is responsible for the increased width of street and increased depths of plantmix, aggregate base and granular borrow between Typical Section # 4 and Typical Section # 6, which is for a Minor Arterial St. The costs set forth in Item # 4 on pgs 12 & 13 of the Annexation Agreement represent the increases in street width and ballast thicknesses that the City is responsible for. These are in addition to the costs for the curb and gutter, asphalt plantmix, crushed gravel and granular borrow for the one/half street width of Typical Section # 4, which as indicated above, is your responsibility. The unit costs (for asphalt plant mix, crushed gravel, granular borrow, water pipe and sewer pipe, etc.) are prices that are representative of recent city projects. We tried to get prices from Zollinger Const. for these items of work, but he never got them to us; consequently, as indicated, we used representative prices from other recent city jobs to calculate the City's share of the cost of this work. Your Engineer in charge of the work (Mountain River Engineering) is supposed to give us a certification that all street and utility work was done in accordance with the City of Rexburg's Standard Specifications and Standard Drawings. They, in conjunction with the Contractor, are also supposed to furnish the City a set of "Record Drawings" showing the true and exact way the street and utilities were actually constructed. As soon as we receive: (1) your Engineer's "Certification" that the project was constructed in accordance with the City's Standard Specifications and Drawings and (2) the "Record Drawings" referenced above, we will authorize payment of the city's estimated $22,131.72 share of the street and utility costs for the subject development. The Developer will be responsible for dedicating the north half street ROW width of 50.5 ft. with a 20 ft. radius connecting this ROW to that along S.H. 33. The Developer is responsible for up to a 22.5 ft width of asphalt pavement (3.5' thick) and the depths of 3/4" Aggregate Base, Granular Borrow and the Geotextile Fabric shown on the referenced Typical Section. If an asphalt surface width greater than 21.5 ft. is needed the City would be responsible for such extra width of asphalt plantmix, 3/4" Aggr. Base, . Granular Borrow & Geotextile Fabric. The Developer is also responsible for the curb and gutter, sidewalk and storm drainage along 1000 North St. The Sanitary sewer along 1000 North St. will be extended to the east on the southerly side of the street. We were going to remove and replace the 12" watermain on the north side of 1000 North St. with a 16" watermain; however, now we have decided to install a 12" watermain along the south side of the street to supplement the 12" line already along the north side of the street. The Developer of the subject property would not be responsible for the costs associated with the sanitary sewer and watermain along 1000 North St. 2 --- The Developer will be responsible for the $10/ front foot charge for the watermain along S.H. 33 for whatever the length of frontage ends up being along S,H, 33. 3 --- The Developer will be responsible for the $10/ front foot charge for the sanitary sewer main along S.H. 33 for whatever the length of frontage ends up being along S,H, 33. 4 --- The Developer will be responsible for the $10/ front foot charge for the storm sewer main along S.H. 33 for whatever the length of frontage ends up being along S,H, 33. 5 --- The Developer will be responsible for the $5.00/ front foot charge for the curb and gutter and a $3.00/front foot charge for partial payment for the asphalt surfacing along S.H. 33 for whatever the length of frontage ends up being along S,H, 33. (Total= $11.00/ front foot for street improvements along S.H. 33) 6 --- The Developer will be responsible for the sidewalk and landscaping along S.H. 33 (between the back of curb and the right of way line). We normally want the back of sidewalk to be on the right of way line, however, in this particular case where the utility strip is so wide and of a variable width, we will work with you on finding a location that is best for both parties. The street right of way cannot be used for vehicle parking or signs, only for sidewalk, bike paths or landscaping. We will eventually also have to get Idaho Transportation Dept. approval of the water, sewer, sidewalk, landscaping and driveway. 7 --- The City of Rexburg will design and construct the 12" waterline and 8" sanitary sewer line along S.H. 33. We would appreciate it if we could get a disk of whatever survey information you have for the subject site. Thanks, Joe Laird
