AMENDMENT TO THE PROTECTIVE COVENANTS

J. EARL GARNER ADDITION
We, the undersigned, constituting a majority of the owners of the lois tocatedin the
J. Earl Garner Addition to the pity of Rexburg, County of Madison, State of Idaho do hereby
amend the Protect'ive Covenants of said addition dated 23 November, 1957 filed in book 178,
pale 288 and recorded as instrument number 109233 inn Madison County as follows -
1. The subsection entitled "App'licatian" commencing at the second full paragraph of
pale I shall be deleted and is hereby amended in its entirety to read as follows:
Application, The residential ares �o�enants in Part A, in the entirety shall apply to
all of the j. Earl Garner Addition according to the recorded plat thereof, with the
exception of Loi 6 and Lot 7 of Block 2 and provided, however that the residential area
covenants shill be modified as to, Lots 1, 2, 3, 4, 5, b, 7, S, 9, 10, and I 1 of Block 1 of
said Addition as sed forth herein.
The commercial area covenants in Part B shall apply to aforesaid lots in Block ?.
2,, Subparagraph 1 of Part A entitled "Residential Area" located on pale 1 shall be
deleted and is hereby amended in its entirety to read as follows:
I . No tot shall be used except for residential purposes, and provided,
however, that Lot 6 and 7 of Block 2 may be used for commercial or park purposes; and,
further provided, that Lots 1, 2, 3, 4, 51 6, 7, S, 9, 10, and I x of Block 1 (collectively
hereafter the i4Haspital Lots"'), may be used for purposes related to the operation of a
hospital and those ancillary services related to the operation of a hospital, provided,
further that said lots shall not be subject to any restriction contained in these covenants
except those set forth on Addendum A attached hereto and incorporated herein. Except
as set forth herein', the Hospital Lots, are hereby released from all restrictions previously
imposed by these covenants. Na amendment to the Protective Covenants as to the
Hospital Lots shall be effective without the consent of the respective owners thereof and
for the purposes of future amendments to these Protective covenants, Madison Memorial
Hospital shall have one rote, notwithstanding the number of lots awned bV the Hospital.
On all remaining residential lots, no building shah be erected, altered, placed or- permitted
to remain on any lot other than one detached single family dwelling not to exceed one
scary in height and a private garage for not more than two cars.
3. This Amendment to the Protective Covenants for J. Earl Garner Addition shall be
signed in counterparts by the amending owners, each of which shall be deemed to be an original
and together shall be deemed to be one instrument upon the attachment of all original signatures
to this amendment which shall be recorded uponn its execution by a majority of all the owners of
the lets located in the J. Earl darner Addition to the City of Rexburg, County of Madison, State
of Idaho,

ADDENDUM A
t . No existing building located on Lots 1, 21 �, 41) 53 b, ?, $, 91) 10,, and 1 1 of Block i
(the "Hospital Lots"), as of the date of the recording of this Amendment of Protective Covenants
shall be utilized as physician offces by Madison Memortal Hospital. Madison Memorial
Hospital may utilize such buildings for ancillary services related to its existing operations,
Madison Memorial Hospital may further elect to continue the use of said bull -dings for residential
purposes. In the event that the Hospital Lots are utilized for any use ether than residential use,
access to the buildings shall be from existing hospital property. No access to such bu'ld'ngs
shall be taken from Morgan Drive or Reed Street.
2. Madison Memorial Hospital shall maintain all buildings located ars the Hospital
Lois in goad condition and repair, consistent with the condition and repair of other properties
encumbered by the Protective Covenants until such time as Madison Memorial Hospital elects to
commence the redevelopment of the hospital Lits_
3.. No abiigati+on hereunder shall prevent Madison Memorial Hospital from
demolishing the buildings located on the Hospital Lots in the process of redeveloping the
Hospital Lots. During such redevelopment Madison Memorial Hospital shall undertake
reasonable efforts to minimize the impact of such on other properties encumbered by the
Protective Covenants. As Madi'son Memorial Hospital removes buildings from thospi
tal Lots
and upon the removal of buildings on at least three contiguous lots, Madison Memorial shall
landscape and screen said groups of at least three contiguous lots in conformance with the site
design plan included herewith. Such landscaping may include fencing as agreed to in the future
between Madison Memorial Hospital and the owners of the subdivision lots.
4. Madison Memorial Hospital shall comply w.h
ith all local zoning ordinances and
regulations as such may pertain to the use of all buildings located on the Hospital Lots.
Notwithstanding such obligation, Madison Memorial Hospital has the right seek the rezoning of
the Hospital Lots and to utilize the Hospital Lots in conformance with any future z
regulation �gu�at�a� ar designation.
