HomeMy WebLinkAboutFOF - Oakey, Steve - 50 & 60 S 1st W - Rezone from MDR to HBDFINDINGS OF FACT FOR ZONE CHANGE FOR STEVE OAKEY On September 25, 2000, Steve Oakey presented to the Rexburg City Clerk an Application for Rezoning for property located at 50 South I" West and 60 South I' West for a zone change from MDR to HBD. 2. On September 27, 2000, Steve Oakey appeared before the Planning & Zoning Commission of the City of Rexburg for a proposed zone change at 50 South l' West and 60 South V West. This request was recommended and approved to go to Public Hearing. On October 10, 2000, the City Clerk sent the Notice of Public Hearing for publication in the local newspaper, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 4. A public hearing was held on November 8, 2000, before the Planning & Zoning Commission of the City of Rexburg for a proposed zone change at 50 and 60 South I' West from MDR to HBD. There were numerous neighbors present stating their opposition to the zone change. A letter was also presented in opposition of the zone change. After discussion it was recommended by Planning & Zoning for this zone change request to go to public hearing before the City Council. On November 13, 2000, the City Clerk sent the Notice of Public Hearing for publication in the local newspaper, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 6. A public hearing was held on December 6, 2000, before the City Council of the City of Rexburg requesting a zone change from MDR to HBD at 50 and 60 South 1' West. There was opposition expressed from the neighbors and a lengthy discussion concerning the Comprehensive Plan and requested changes from the neighborhood. Motion was made to table this matter until such time that Planning & Zoning can review the requested changes to the Comprehensive Plan. On December 13, 2000, Planning & Zoning reviewed the Comprehensive Plan at length concerning any changes or future changes in the area of 50-60 South I' West. It was the unanimous decision of Planning & Zoning that this area should remain shown on the Comprehensive Plan as Highway Business District and there was nothing they felt would change this in the foreseeable future. The matter was returned to City Council for their final decision with the recommendation that it remain on the Comprehensive Plan as presently shown. 8. At City Council on January 3, 2001, a motion was made to retrieve this matter from the table for a discussion and a possible decision. There was a resident at the meeting speaking in opposition to the change in that it may need to be changed in the future but it was not a change that needed to happen now. After discussion it was moved and seconded that the zone change be granted to Steve Oakey changing 50-60 So. I" West from an MDR zoning to a HBD (Highway Business District) zone.
