FINDINGS OF FACT
FOR
FINAL PLAT APPROVAL FOR MITCH NEIBAUR
On February 23, 2000, Mitch Neibaur appeared before the Planning & Zoning
Commission for the City of Rexburg requesting input and direction as to the
development of 16 acres of property adjacent to the Wilcox Potato Fresh Pak south of
town, which property is located in the impact zone. Property is zoned HBD Industrial
Subdivision.
The Planning & Zoning Commission reviewed the plans, made recommendations and
suggestions. They suggested that Mitch contact District 7 Health Department as to their
requirements for wells and septic tanks, make the changes suggested and return with a
preliminary plat.
3. On May 10, 2000, Mitch Neibaur met with the Planning & Zoning Commission with a
preliminary plat showing the appropriate easements, roads and division of lots and with
approval from the Heath Department for a septic system. It was noted that the plat
should indicate that Lot 6 is a non -buildable lot, there are no dedicated roads and all road
maintenance will be owner responsibility. It was recommended this project go to public
hearing on June 14 before Planning & Zoning and June 21 before Rexburg City Council.
4. The City Clerk published the Notice of Public hearing in the local newspaper on May 24,
2000, and May 31, 2000, posted a notice on the property and sent notices to all property
owners within 300 feet of the above mentioned property.
On June 14, 2000, a Public Hearing was held before the Planning & Zoning Commission.
It was recommended that street names be assigned for emergency services and that any
person with an interest in this property sign the plat. No one appeared in objection to the
proposed subdivision. The plat was approved on condition of City Departmental
approval and recommended for public hearing before the Rexburg City Council.
6. On June 21, 2000, a Public Hearing was held before the City Council.
No one appeared in objection to the proposed subdivision. The final plat was approved
on conditions set out and City Departmental approval.
