Todd Smith/Rexburg Heights - Annexation
� . On May 20, 2-005, Todd Smith presented to the Rexburg Planning & Zoning Secretary a Request and
Application for Annexation into the City of Rexburg. The two properties ars 875 S Soh and 883 S 5'-h
W. Added to the ,Annexation by the City of Rexburg are the followeing properties:
a. 1121 S Soh W
b. RP 0 6N40E31 14 8 0 1 — University Property
c. 398 W Poleline Rd.
d. Rexburg Heights Subdivision
2. an .duly 1, 2005 the City Clerk sent the Notice of Public Hearing to be published in the local newspaper
for July 5, 2005 and July 30; 2005. .A, notice was posted on the properly and sent to all property owners
within 304 feet of the above mentioned property.
3. On August 4, 2.Q05, the proposals went to alae Rexburg Planning& Zoning Commission to Annex the
areas afore mentioned.
Under Area L, presidents of Rexburg Heights referred to the petition that 65 of the 68 residents had
signed concerning snow removal, zoning clarification and taxes. They petitioned for a gourd faith
agreement. Most commissioners felt it appropriate to include Rexburg Heights Subdivision in the annex
with recommendation that City Council consider the Petition from the residents Rexburg Heights
subdivision. Thaine Robisnson motioned to recommend ailnexng Area # 1 with the strong
x ecammendation for the residents of Rexburg Heights Area that the desires of the petition try to find a
resolve with the City Council; that they try to meet the conditions. Ted Hill seconded the motion.
Thaine Robinson an -tended his motion to exclude the two houses since they do not have City services at
this time. Ted Hill seconded the amended motion. Thaine Robinson amended his motion to include
that City staff review the storm drainage and street conditions to see if they feel life theyare ably to take
care of these problems. Ted Hill seconded his amended motion.
Those in favor: Ted Hill, Thaine Robinson, Randall Poster, Joseph Laird, Chairman oyer, Charles Anderse
Mike Ricks.
Those opposed: David Stein
Motion carried.
Todd Smith presented to the Rexburg Planning & honing Commission the Request Aiuiex his two
properties (Area 2). He was extended City services based an emer ency due to his septi.c tank. failing,,
pending Annexation approval. Charles Andersen naUtianed to recommend that the annexation go
forward as to the request. Mike Rick's seconded the maiion. None opposed, motion carried.

1. On May 20, 2005, Todd Smith presented to the Rexburg Platming & Zoning Secretary a Request
and Application for Annexation into the City of Rexburg. The two properties are 875 S 5th W and
8831 S 5t' W. Aided to the Annexation by the City of Rexburg are the following properties:
a. 11Z1 S 5ffi W
b. RP06N40E.3'14801 — University Properly
c. 398 'ALT Polefine Rd.
d. Rexburg Heights Subdivision
2. On July I, 2405 the City Clerk sent the Notice of Public Hearing to. be published in the local
newspaper for July 5, 2Q05 and July 30, 20[]5. A notice was posted on the property and sent to all
property owners within 3a4 feet of the above mentioned property.
3. On August 4, 24x5, the proposals rent to the Rexburg Planning & Zoning Commission to Annex
