Yours truly, CITY OF REXBURG Marilyn Hansen City Clerk FINDINGS OF FACT FOR ANNEXATION FOR HAWKINS COMPANIES On November 11, 2000, Clint Boyle on behalf of Hawkins Companies, presented to the Rexburg City Clerk a Request and Application for Annexation for property located on 7' South and Old Hwy 191. 2. On November 15, 2000, Clint Boyle appeared before the Planning & Zoning Commission for the City of Rexburg requesting annexation of property located west of old Hwy 191 on 7" South, which property is in the Impact Zone and is comprised of approximately 80.69 acres. The request is to annex the entire parcel but with 18.58 acres as Highway Business District (HBD), 3.34 acres as Light Industrial (LI), 40.50 acres High Density Residential (HDR), and 20.42 acres Low Density Residential (LDRI). It was recommended that this project go to public hearing. 3. The City Clerk sent for publication the Notice of Public Hearing in the local newspaper on November 27 and December 4, 2000, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 4. Due to a technical problem in the process of this hearing with the Comprehensive Plan it was concluded the public hearing should be cancelled and rescheduled. 5. The City Clerk sent for publication the Notice of Public Hearing in the local newspaper on December 6 and December 13, 2000, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 6. On December 21, 2000, Doug Matthews on behalf of Hawkins Companies, appeared before the Planning & Zoning Commission for the City of Rexburg at a public hearing requesting annexation and zone change of property located west of Old Hwy 191 on 7`" South. There was some public comment with regards to buffer zones between the development and existing homes. It was moved and recommended that this request be approved for public hearing before the City Council. 7. The City Clerk sent for publication the Notice of Public Hearing in the local newspaper on December 29, 2000 and January 10, 2001, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 8. On January 17, 2001, Hawkins Companies appeared before the City Council for the City of Rexburg requesting annexation and zone change for the property located near west of Old Hwy 191 and 7" South. There was public comment, not opposing annexation but in opposition to the amount of acres being zoned High Density Residential. A letter from Teddie Lou Steiner was read into the record in opposition After discussion it was recommended by motion that this annexation and zone change be tabled until the February 7 City Council meeting. 9. On February 7, 2001, before the Rexburg City Council a motion was made to retrieve the Hawkins Companies item from the table. There was discussion among the Council concerning the number of acres being zoned HDR and the use of the zoning. Doug Matthews representing Hawkins Companies agreed the company would be willing to condition the property to not allow for single student housing in the HDR zoning. One resident appeared in opposition to the location of the HDR portion of this project. After discussion among the Council concerning these matters, a motion was made recommending that this annexation and zone change be approved as requested following the recommendation of Planning and Zoning as being in the community's best interest. 6q& - Stephen kollinger, City Att6rhey FINDINGS OF FACT FOR ZONE CHANGE FOR WESTATES COMPANIES On November 20, 2001, Westates Companies presented to the Rexburg City Clerk a Request and Application for Zone Change on property located in Lots 2 and 3 in Block 2 of the Hawkins Companies Subdivision known as address 7' South and old Hwy 191 in the City of Rexburg. It is requested said property be changed from Highway Business District (HBD) to High Density Residential (HDR) for the purpose of developing a subdivision of 4-plex lots. 2. On November 28, 2001, Stan Roland was unable because of bad roads to appear. John Millar presented the request before the Planning & Zoning Commission for the City of Rexburg requesting that Lots 2 and 3 in Block 2 of the Hawkins Companies Subdivision better known as property at 7`h South and Old Hwy 191 have a zone change from HBD to HDR. After review it was determined this request did not comply with the Comprehensive Plan, therefore it was moved to table the request and have it added to the list of Comprehensive Plan changes to be discussed in January, 2002.
