AFFIDAVIT OF PUBLICATION

I, Jeff Rydalch, being first duly sworn, depose and say, that
I am the business manager of the STANDARD
JOURNAL, a 5 times a week newspaper published 5 times
a week in Madison and Fremont Counties, Idaho; and I do
solemnly swear that the Public hearing - 24 South 2nd East,
a copy of which notice appears attached hereto, was
published in the regular and entire issue of said newspaper,
and not in any supplement issue, once every other week
thereof for two weeks, the first publication having been
made on February 26, 2005 and the last publication having
been made on March 12, 2005.
Further, that said newspaper is one of general circulation in
said county; that it is a legal newspaper, conforming to legal
specifications under the Idaho Statutes; that it has at least two
hundred bona fide subscribers living within the county of
publication; and that it has been continuously and
uninterruptedly published in said county during a period of
seventy-eight consecutive weeks prior to the first publication
of the said notice.

Re: Proposed Walgreen's Development
The proposed Walgreen's development was reviewed by the Design Review Board of the
Planning and Zoning Commission in a four hour meeting on April 13, 2005, and subsequently
was duly considered by the full P&Z Commission in our regular meeting of April 21, 2005.
After careful and thorough deliberation of the matter, the unanimous decision of the Planning
and Zoning Commission was to forward the proposal to the City Council for "Consideration for
Approval with Conditions", and that the full minutes of the Design Review Board also be
forwarded on to document and support the recommendation.
Accordingly, attached please find the Design Review Board minutes of April 13, 2005 reviewing
the careful research and deliberation that occurred, the concerns that were identified and
studied, the rationale used in considering design criteria for this particular location,
recommendations for conditions of approval, and some concluding remarks about the benefit of
the process and the advantages that having the new design standards in the new Code
provides the City in obtaining a development proposal more consistent with the City's goals and
objectives.
The minutes will speak for themselves. However, there are two additional items the
Commission wanted bring to your attention. First, in discussing the architectural elements at the
bottom of page 5 in the minutes, the brick archway treatment does not apply to the back walls of
the structure. Secondly, the Commission felt it would be advisable to eliminate the on street
parking on Main Street in front of the Walgreen's property. That parking is very difficult even at
present where the traffic backup from the signal precludes people being able to easily get in and
out of the parking spaces. The Commission felt the public would be better served if that parking
were eliminated under the new development.

NOTICE IS HEREBY GIVEN, that a Public Hear-
ing will be held before the City Council of the
City of Rexburg, Idaho, Wednesday, March 16,
2005. at 7:40 p.m., in the City Council Chambers
of the City Building at 12 North Center, Rexburg,
Idaho, regarding a land exchange between the
City of Rexburg and Phillips Edison & Company,
175 East 400 South, Suite 402, Salt Lake City,
Utah, 84111. The said property considered an
