Motion was seconded by Mike, all voted aye, none opposed. Discussion concerning fences, abandonment of alleys and park strips. Public Hearing for Conditional Use Permit for American Self Storage storage units John Millar read the Notice of Public Hearing. John reviewed the site plan with the Board and explained the location of the proposed units. The site plan has been reviewed by the Fire Department. The public hearing was opened. There was no public comment and the public hearing was closed. Discussion concerning paving or gravel, Nick Baldwin stated it would be paved but would be 12 to 18 months before that is completed. Also fencing was discussed, Nick stated they would like to have one row of barbed wire across the top of the fence. Discussion. Ted made a motion to approve the Conditional Use Permit for storage units to go to public hearing before the Council and allowing for one strand of barbed wire across the top of the fence. Motion was seconded by Mike, all voted aye, none opposed. Request for Zone Change for Nelda Jeppesen John Millar described the location of the approximate 10 acre parcel located on the southeast corner of 7' South and 5`h West owned by Nelda Jeppesen and family. A house sits right on the corner which is not a part of the property. The property is currently zoned Rural Residential, properties east and west of this site were recently annexed. This request is for annexation bringing it in under the HDR2 zone. Discussion concerning boundaries, recent annexations, water and sewer, and the Comprehensive Plan. John Watson reviewed the number of projects that have requested zone changes and then nothing has ever happened with the project and ask the question if this property has a buyer. Judy Davis Hobbs from Real Estate by Archibald, the real estate agent for Nelda Jeppesen, stated the property is not sold, there is not a contract for the sale of the property, it has been marketed pending re -zoning in that the value of the property is substantially different if rezoned for High Density Residential 2 than for Rural Residential. The intent is to sell the property. Mrs. Jeppesen lives on the property, the sale of the property will include a life estate to Mrs. Jeppesen. Further discussions concerning projects, role of Planning & Zoning and the process for this request. This matter is going to public hearing for annexation, they are requesting that in the course of that request, the property be zoned at HDR2. Doug made a motion to send this request for annexation and zone change to public hearing. John Watson seconded the motion, all voted aye, none opposed. Davawn welcomed the scouts in attendance. Authority of Commission to Review Conditional Use Permits. The Planning and Zoning Commission may, without approval of the Council, grant the following conditional use permits: Item (1) Permits for parks (2) Permits for nursery schools, day care centers, and primary and secondary schools (3) Permits for churches, synagogues, and temples (4) Permits for funeral and crematory services and cemeteries (5) Permits for nursing homes and boarding houses (6) Permits for home occupations under Section 4.1 OB (7) Permits for developments with eight or less dwelling units (8) Permits for government buildings (9) Add new category: Household goods warehousing and storage Action Leave as is Delete primary and secondary schools Leave as is Delete cemeteries Delete nursing homes Leave as is Change to four dwelling units Leave as is All other conditional use permits may only be granted after review and recommendation by the Commission and approval by the City Council. The Commission and the Council shall each hold a public hearing. It was also recommended that a formal notice be sent to applicant after approval of a Conditional Use Permi� /Notice would state the conditions and if the conditions are violated or not met there would b8V0 day period to cure the problem, failure to comply with these terms may result in revocation of the Conditional Use Permit. This statement should also be added to the Conditional Use Permit Application. 11 Mike made a motion to approve the Zoning Ordinance changes in the Land Use Schedule, including adding the High Density Residential 2 (HDR2) category, the changes to the Authority of Commission to Review Conditional Use Permits and the change for the Conditional Use Permit procedure. Motion was seconded by Winston. All voted aye, none opposed.
