HomeMy WebLinkAboutFOF - Zollinger Land ExchangeFINDINGS OF FACT FOR PROPERTY EXCHANGE On May 8's, 2002, Stephen Zollinger, representing Keith Zollinger, presented to the Rexburg City Clerk a Request for Property Exchange between the City of Rexburg and Keith Zollinger, said property located at 23 South Center in the City of Rexburg, Madison County, Idaho. 2. On May 15`", 2002, Ray Michaelson, owner of Gringo's Restaurant located in Keith Zollingers building at 23 South Center, appeared before the City Council of the City of Rexburg requesting a property exchange with the City of Rexburg. It was recommended that this request should go to public hearing. At this time, Stephen Zollinger, City Attorney, submitted a letter informing the Council that he would not be able to give legal advice on this issue due to a conflict of interest. Chip Stanley will represent the City of Rexburg on any issues of a legal nature that arise. 4. Values and property lines were determined and on May 17'", 2002, the City Clerk sent the Notice of Public Hearing to be published in the local newspaper on May 20s' and May 31', 2002. A notice was posted on the property and sent to all property owners within 300 feet of the above mentioned property. 5. On June 5, 2002, Stephen Zollinger, representing Keith Zollinger and Ray Michaelson, representing Gringo's Restaurant, appeared before the City Council of the City of Rexburg requesting a property exchange between Keith Zollinger and the City of Rexburg. Chip Stanley was present as legal council. There were comments made from the public and discussion among the City Council members. A motion was passed to table the issue. On June 19'", 2002, a motion was made and passed to recall from the table the property exchange between the City of Rexburg and Keith Zollinger. After discussion a motion was passed to approve the proposed property exchange between the City of Rexburg and Keith Zollinger contingent upon the plat review. p Stanley, Attorney at Law
