ANNEXATION AND ZONE CHANGE
On March 5, 2002, Ted Whyte presented to the Rexburg City Clerk a Request and
Application for Annexation and Zone Change on property located at approximately 480
So. 1500 West within the City of Rexburg Impact Area, said property to be annexed and
changed from Rural Residential (RR) to Medium Density Residential (MDR).
2. Said request for annexation and zone change was not in compliance with the
Comprehensive Plan. On February 13, 2002, Ted Whyte appeared before the Planning &
Zoning Commission for the City of Rexburg requesting the Comprehensive plan be
changed on the above mentioned property to multi -family. It was recommended by
Planning & Zoning that this matter be sent to City Council for public hearing on the
Comprehensive Plan with a recommendation that it be changed to Multi -family.
On March 14, 2002, Ted Whyte appeared before the City Council for the City of Rexburg
requesting the Comprehensive Plan be changed on the above mentioned property to multi-
family. It was approved by the City Council to change to multi -family the area on the
Comprehensive Plan map at approximately 480 So. 1500 West.
4. On March 18, 2002, the City Clerk sent the Notice of Public Hearing before the Planning
& Zoning Commission on April 10, 2002, for publication in the local newspaper on
March 22 and April 3, 2002, posted a notice on the property and sent notices to all
property owners within 300 feet of the above mentioned property.
On April 10, 2002, Ted Whyte appeared before the Planning & Zoning Commission for
the City of Rexburg requesting annexation and a zone change from Rural Residential (RR)
to Medium Density Residential (MDR) on property located at approximately 480 So.
1500 West. There was no opposition expressed concerning this zone change. It was
recommended by Planning & Zoning that this request be approved, and set for public
hearing before the City Council.
6. On April 12, 2002, the City Clerk sent the Notice of Public Hearing before the City
Council on May 1, 2002, for publication in the local newspaper on April 15 and April 24,
2002, posted a notice on the property and sent notices to all property owners within 300
feet of the above mentioned property.
On May 1, 2002, Ted Whyte appeared before the City Council of the City of Rexburg
requesting annexation of property located at 480 So. 1500 West with a zone classification
to Medium Density Residential. There were no public comments concerning this zone
change. It was moved and unanimously approved that the Council take the
recommendation of Planning & Zoning and approve the annexation and requested zone
change to Medium Density Residential (MDR) to make it consistent with neighboring
property and it would be the best use of the property in this location.
