FOR
ANNEXATION & ZONE CHANGE
1. Judy Hobbs, representing Nelda Jeppesen, presented to the Rexburg City Clerk a Request
and Application for Annexation and a Zone Change on property located at 1042 South
1000 West in Madison County, said property to be annexed and changed from Rural
Residential (RR) to Medium Density Residential (MDR).
2. On May 8a`, 2002, Judy Hobbs appeared before the Planning & Zoning Commission for
the City of Rexburg requesting annexation and a zone change of said property from Rural
Residential (RR) to Medium Density Residential (MDR). It was recommended that this
request should go to public hearing. At this time, Cal Hulse of 1038 South 1000 West
was also requesting annexation and a zone change from RR to MDR. The Commission
said that these two properties could be noticed, posted and advertised as one hearing and
property owners may share in the costs. Judy Hobbs, representing Nelda Jeppesen, and
Cal Hulse agreed to this arrangement.
3. On May 23`', 2002, the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper on May 24h and June 5's, 2002. Said notice was posted on the
property and sent to all property owners within 300 feet of the above mentioned property.
4. On June 12`s, 2002, Judy Hobbs and Sharron Jeppesen, representing Nelda Jeppesen and
Cal and Christine Hulse, appeared before the Planning & Zoning Commission for the City
of Rexburg requesting annexation and a zone change from RR to MDR on property
located at 1042 and 1038 South 1000 West. There were comments of opposition of
encroachment on a residential neighborhood and concern for safety of school children
from several neighbors. After discussion and reviewing of the Zoning Ordinance, page 20,
(comparing MDR and LDR1 uses) the Planning and Zoning Commission recommended
annexation of the above properties with MDR zoning and that this request be approved
for public hearing before the City Council.
5. On June 13a 2002, the City Clerk sent the Notice of Public Hearing to the local
newspaper to be published on June 14' and June 26t°, 2002. Said notice was posted on
the property and sent to all property owners within 300 feet of the above mentioned
property.
6. On July 3`d, 2002, Judy Hobbs and Sharron Jeppesen, representing Nelda Jeppesen and
Cal and Christine Hulse, appeared before the City Council of the City of Rexburg
requesting annexation and a zone change from RR to MDR on property located at 1042
and 1038 South 1000 West. There were letters read and comments from the public with
regards to increased traffic, safety, future development, property values and sufficient
property in the City that is already zoned HDR or MDR After much deliberation and
discussion among the council members it was moved and approved to follow the Planning
& Zoning Commissions recommendation and annex the above mentioned property into the
City and re -zone the property from Rural Residential (RR) to Medium Density Residential
(MDR).
Ordinance 878 annexing the above property with a zone change from RR to MDR was
created and published.

FINDINGS OF FACT
FOR
ANNEXATION AND ZONE CHANGE
1. On April 2, 2002, Cal Hulse presented to the Rexburg City Clerk a Request and
Application for Annexation and Zone Change on property located at 1038 So. 1000 West
in the City of Rexburg, said property to be changed from Rural Residential (RR) to
Medium Density Residential (MDR).
2. On April 10, 2002, Cal Hulse appeared before the Planning & Zoning Commission for
the City of Rexburg requesting annexation and zone change on property located at 1038
So. 1000 West from Rural Residential (RR) to Medium Density Residential (MDR).
This request was denied to go to public hearing for the reasons it was felt the
neighborhood should remain LDRI for the time and other property located in the same
neighborhood had been denied a zone change.
