Yours truly, CITY OF RE)MURG Marilyn Wasden City Clerk FINDINGS OF FACT FOR ANNEXATION AND ZONE CHANGE FOR BILL HENDERSON On October 18, 2001, Bill Henderson presented to the Rexburg City Clerk a Request and Application for Annexation and Zone Change on 80 acres of property located between 150( West and 5' West in the City of Rexburg, said property to be changed from Agriculture (A) with a portion to be zoned Low Density Residential (LDRI) and a portion to be zoned High Density Residential 2 (HDR2) for the purpose of creating a subdivision. 2. On October 24, 2001, Kurt Rolland appeared on behalf of Bill Henderson before the Planning & Zoning Commission for the City of Rexburg requesting annexation and zone change of said 80 acres between 1500 West and 5' West from Agriculture (A) with a portion to be zoned Low Density Residential (LDRI) and a portion to High Density Residential 2 (HDR2). The request was found to be inconsistent with the Comprehensive Plan and it was therefore recommended by Planning & Zoning that this request go to public hearing with a portion to be zoned Low Density Residential (LDRI) and the balance to be zoned Low Density Residential 2 (LDR2). On October 25, 2001, the City Clerk sent the Notice of Public Hearing advertising a public hearing before the Planning & Zoning Commission on November 14, 2001, for publication in the local newspaper on October 29 and November 7, 2001, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 4. On November 14, 2001, Kurt Rolland appeared on behalf of Bill Henderson before the Planning & Zoning Commission for the City of Rexburg requesting annexation and zone change on 80 acres of property located between 1500 West and 5' West from Agriculture (A) to a portion zoned as Low Density Residential I (LDRI) and a portion zoned to Low Density Residential 2 (LDR2). There was some opposition to the split zoning request in that neighboring properties are zoned LDRI and the LDR2 zone would make for smaller lots similar to a trailer court which would not be consistent with the LDRI zone. It was moved by Planning & Zoning that this request be approved for public hearing before the City Council on the recommendation it be annexed and the entire proposal be zoned Low Density Residential 1 (LDRI). 5. On November 15, 2001, the City Clerk sent the Notice of Public Hearing advertising a public hearing before the City Council on December 19, 2001, for publication in the local newspaper, posted a notice on the property and sent notices to all property owners within 300 feet of the above mentioned property. 6. On December 18, 2001, Kurt Rolland on behalf of Bill Henderson telephoned the City Clerk and requested their project betaken from the December 19, 2001, agenda.
