On behalf of the Board of Trustees of Madison Memorial Hospital, I wish to state clearly that the hospital has not been involved, nor given any direction to Planning and Zoning, to the hospital architect, or to anyone to proceed with any consideration of zoning a professional overlay of streets coming to the hospital. We do not consider that issue to be one that the hospital would take a position on, since it is secondary to our primary focus and mission and immediate impact area, which would be locations immediately adjacent to the hospital. The article is unfortunate in several ways: 1) it raises issues including the hospital with no knowledge of hospital officials being appraised prior to the article, 2) it suggests that the hospital is seeking to establish jurisdiction far in excess of its recognized authority and responsibility in the community, and 3) that the hospital is in fact considering plans for additional office space outside of the already existing designated and zoned property for hospital purposes. For all three above issues, the answer clearly is no. In addition, the article also infers that Don Sparhawk is representing BYU-Idaho in his comments, being represented by his title, as well as the university name. Madison Memorial Hospital has an excellent working relationship with BYU-Idaho and cannot imagine that there would be any interest from the university to take such a position, being absolutely non -germane to the university mission, whatsoever. It is interesting, since we were made aware through an earlier article in the local press of an attempt to have residential property rezoned, not immediately adjacent to the hospital, that any consideration of zoning should include at least consideration for the hospital's zoning as it relates to surrounding properties. We did send the letter on February 27, 2002 to inform the Planning and Zoning Commission of the importance of any planning, to include the hospital for any future considerations, if in fact, such plans were to proceed. Clearly the Board of Trustees is looking for innovative ways that the hospital can continue its growth and expansion on its existing property and the direction we have given our architect, is to work to accomplish that objective. We clearly want to be represented of having had no involvement whatsoever, in any of the preceding events and will focus our full time and effort, solely on our property and issues that will be germane directly to Madison Memorial Hospital. Two family dwelling units are conditional uses within this zone. The maximum density permitted in this district is eight (8) dwelling units per acre. 3.6 Medium Density Residential (MDR) The Medium Density Residential is established to protect stable neighborhoods of detached single family dwelling on smaller lots and multi -family housing not to exceed four dwelling units per development as a use by right. Restoration or rehabilitation of older homes in this district shall be encouraged. Conditional uses shall be compatible with an atmosphere of low building heights, low traffic volumes, ample off-street parking, and low nuisance potentials at a higher density than LDR zones. The maximum density permitted in this district is sixteen (16) dwelling units per gross acre. 3.7 High Density Residential (HDR) The High Density Residential zone is established to provide higher density residential housing areas served by collector and arterial streets. The zone shall be characterized by dwellings for three and more families, ample off-street parking, higher traffic volumes, proximity to Ricks College and other traffic generators and low nuisance potential. Thirty (30) dwelling units per gross acre is the maximum density permitted. 3.8 Professional Office Overlay District (PO) The PO is established to provide land for professional offices near the community's a medical facilities and in areas of transition from residential to# commercial. Such a offices shall be located and designed to conform to the residential character of the neighborhood. Site plan review by the Planning and Zoning Commission is '�. required to minimize the potential nuisance activities of offices in the residential neighborhoods. 3.9 Central Business District (CBD) The CBD is established to recognize the historic central retail and service center of the City. Front setbacks are not common and lot coverage may approach or be one hundred percent. On -street serves many of the businesses. Office and residential uses are encouraged on the upper floors of the downtown buildings, and first floor residential uses are conditional uses. 3.10 Highway Business District (HBD) The Highway Business District provides for a wide range of commercial and service oriented activities along the City's major streets. That type of citizen feedback is particularly helpful to us and we welcome such public input. Unfortunately, our effort to conduct meaningful and proper public dialogue has fallen victim to a number of unfortunate circumstances and even greater misunderstanding as this issue has been played out through channels other than those designated by due process. In light of the circumstances, and in response to severly inaccurate news articles and your letter of March 5th, I would like the opportunity to help clear up some of the misunderstandings and refocus on the issue and the planning process. In doing so, I speak principally for myself and also as the designated voice for the Planning and Zoning Commission. I wish to personally apologize and accept responsibility that an important fact concerning the professional office overlay was completely overlooked in our discussion with you at the February 27th meeting. You asked where the potential was and we correctly stated that the matter had been discussed and proposed boundaries had been established. What I, and apparently everyone else, failed to remember was that part of the motion setting forth the potential boundaries of the professional office overlay was to go ahead and call for public input on the concept via a public hearing. It will be hard for us to convince you of this after the fact, but let me assure you it was an honest oversight and certainly not anything intentional to withhold information or mislead you in any way. I can only hope that the spirit of this letter and the effort to make things right will convince you of my sincerity. It may help for you to know that since January 1st of this year, our four planning and zoning meetings have averaged four hours in length and that during those four meetings 62 individual issues have come before the board, nearly every one of which required individual discussion and vote proposing action. Nineteen of the 62 issues were discussed twice, making a total of 81 individual area discussions in four meetings. There's no question that I personally should have known and been in command of information and circumstances to be able to properly report the status of the professional office overlay concept. At the same time, I would hope you would agree it is unreasonable to expect that anyone would have instant command of every detail related to all those discussions. We rely heavily on city staff and clerical help to track these individual issues and therefore have a tendency to put some of the details out of our mind knowing they will be addressed in proper course and due time by those responsible. Unfortunately (again), the individual who had taken the original minutes when the motion was made and who then subsequently sent the hearing notice to the paper was not present at the meeting when you were and no one else who was participating in the discussion had personal knowledge of the fact that it had been advertised. As soon as I was made aware of the situation that a public hearing had indeed been scheduled for the professional office overlay issue, and that such status was not in accordance with information you had been given in our official meeting, I promptly and personally called for a cancellation of the public hearing. This was done to allow us all time to regroup, and more particularly for you and your neighbors to have adequate time to prepare for giving meaningful and constructive input during the public hearing process. At the same time, having discussed the professional office overlay concept, and having established potential boundaries (which, by the way are significantly reduced from initial discussions), we are anxious to have public input on the matter. The Planning and Zoning Commission feels that some type of professional office overlay concept is in the best interest of the community in terms of economic viability, future growth, and long term stability. We recognize and are sensitive to the fact that the current concept does take in areas of long-established residential neighborhoods. We have also observed a changing and transition over time of some of these established neighborhoods in the area to other uses and trends. A professional office overlay is a useful tool in helping older areas such as the one being considered to more softly transition to changing uses and growth pressures. It will arrest declining property values and will provide increased economic opportunities for property owners and professionals alike. Experience here and elsewhere has shown that a professional office overlay will not result in wholesale, radical changes to the area as many presume. In most cases, individuals are unwilling to sell their properties for such development, so no change occurs. In a lot of other instances, professional offices are established simply by remodeling the interior of existing homes for professional office use, which allows the character and appearance of the area to carry forward. Purchase and complete demolition of existing property for new construction is usually rare or could even be prohibited, depending on how the overlay is established in the planning and zoning ordinance. I have enclosed a copy of current information on Rexburg's professional office overlay zone for your reference. It is possible to consider changing the existing statute or perhaps to adopt terms and conditions for the current overlay concept that may create further protection. On a different but related matter, I was also dismayed by the banner headline in the Post Register associating your private, individual testimony before the Planning and Zoning Commission with your position at BYU-Idaho. Such erroneous reporting and wanton editorialism is clearly irresponsible and inflammatory. You should know that I personally called the managing editor of the Post Register to enter a formal complaint about their inappropriate journalism. Such reporting at a time when the relationship between the City and the University is pressured by growth issues does little to help matters. I received assurances from the managing editor that greater care and caution would be taken in the future on planning issues in general, and specifically on avoiding the temptation to make associations where there are none. I should also note I have received a letter from Keith Steiner, Chief Executive Officer for Madison Memorial hospital, clearly indicating the fact that the hospital is not behind the professional office overly concept being set forth, that they have not authorized nor asked any professionals to speak in their behalf, that they have no specific plans for such a proposal in the future, and that they desire these positions to be made clear to everyone involved. We dutifully so note and publicly stated such in our March 13th P&Z meeting. Our plan of action from this point forward will be to discuss these unfortunate circumstances with the P&Z Commission and to explain the reasons for cancellation of the public hearing on the professional office overlay issue. I will then ask the board their feelings as to when and how this issue should be pursued, or not. We will make this an agenda item at our March 27th meeting and invite you to attend and hear the discussion firsthand if you so desire. At any rate, I will personally inform you as to the disposition of this issue, particularly if it is to move forward and opportunity for public input is scheduled. Thank you for your great patience and understanding in the face of such trying circumstances. With the current growth pressures in Rexburg, we are facing a mountain of challenge and a myriad of issues that, while trying to do our best, we are not always able to keep our arms completely around on a moment's notice. I would be happy to meet with you personally and individually to give further light and detail on the circumstances, to answer questions or concerns you may have about this issue, or to further explain the general planning process and how it is carried out on a given issue. At the same time, we are keenly aware of established neighborhoods and desires on the part of existing residents to see that their neighborhoods are protected. We are committed to seeing that their voice is heard through duly established public involvement processes. Accordingly, we plan to discuss moving forward with exploring the professional office overlay issue. We will make it clear to the public and others concerned that this is being done on its own merits and not with any impetus, request, or incentive from the hospital. If we do, we invite and encourage you to give input during this process since the outcome of the proposal could have an impact on your operation and the future plans. Your providing formal input would help us better visualize how such a proposal may work, or alternately, could give you an additional opportunity to clarify that this is not being done at the hospital's request and/or that you have no interest in it. If approved, we believe this proposal would lead to the eventual destruction of our well-established residential neighborhoods that currently are legally protected by the Low Density Residential 1 Zone in which we live. Instead, we ask our city officials on the Planning and Zoning Commission and the City Council to represent our desires and to protect our families, our homes, and our neighborhoods from further encroachment by commercial development, including additional professional offices.
