Lowe: Steven, The City of Rexburg is unable to provide the requested service to enforce the Architectural Committee's building standards for Eaglewood Estates in Rexburg. The City has adopted the International Building Codes (IBC 2000) this year. However, the City Building Inspectors do not have jurisdiction of protective covenants in private developments. Neighborhoods are encouraged to have neighborhood Associations in Rexburg to promote and protect the neighborhoods. The City does appreciate the efforts of the developers of Eaglewood Estates to promote protective covenants. If you have any questions, please do not hesitate to call me at 359-3020, Ext. 313. Center Rexburg, Idaho 83440 Regarding: Building Plan Application and Approval Eaglewood Estates Mr. Kay: We hope that you and Rexburg City can help us enforce some minimal building standards at the new Eaglewood Estates [700 South and 400 East]. Eaglewood Enterprises, L.C., as the Declarant, has recorded specific Declarations of Covenants, which require each Eaglewood Estates Subdivision Lot Owner to submit a set of plans to an Architectural Committee for review and approval PRIOR to applying for a Rexburg City Building Permit. The Architectural Committee will verify that each new Eaglewood Estates home has the correct set backs, exterior finishes and minimum square footage requirements. After our review, we will provide each Eaglewood Lot Owner with a "Certificate of Plan Approval' [copy attached] that will be stamped and signed. We can avoid many problems and conflicts if you will not issue any Eaglewood Estates Subdivision building permits until and unless the Rexburg City Building Plan Application is accompanied by an original Eaglewood Estates "Certificate of Plan Approval'.
