ZONE CHANGE FOR RANDY BIRD
On February 26, 2002, Randy Bird presented to the Rexburg City Clerk a Request and
Application for Zone Change on property located at 455 So. 2nd East in the City of
Rexburg, said property to be changed from High Density Residential (HDR) to High
Density Residential 2 (HDR2) for the purpose of building higher density apartments.
2. On February 27, 2002, Tom Sainsbury appeared before the Planning & Zoning
Commission for the City of Rexburg requesting a zone change on said property from
Highway Business District (HBD) to High Density Residential 2 (HDR2). This request
was denied because the ordinance requires a minimum of 2 acres for High Density
Residential 2 (HDR2) and this parcel of property comprises 1.98 acres which is
insufficient to meet the requirements of HDR2.

On February 26, 2002, Randy Bird presented to the Rexburg City Clerk a Request and
Application for Zone Change on property located at 455 So. 2nd East in the City of
Rexburg, said property to be changed from High Density Residential (HDR) to High
Density Residential 2 (HDR2) for the purpose of building higher density apartments.
2. On March 6, 2002, the City Clerk sent the Notice for a Public Hearing before the
Planning & Zoning Commission on March 27, 2002, for publication in the local
newspaper on March 11 and March 20, 2002, posted a notice on the property and sent
notices to all property owners within 300 feet of the above mentioned property.
On March 27, 2002, Tom Sainsbury, representing Randy Bird, appeared before the
Planning & Zoning Commission for the City of Rexburg requesting a zone change on said
property located at 455 So. 2"d East from High Density Residential to High Density
Residential 2 (HDR2). There was some opposition with regards to access and traffic. It
was approved by Planning & Zoning that this request be recommended for approval and
sent to public hearing before the City Council.
4. On March 28, 2002, the City Clerk sent the Notice for a of Public Hearing before the
City Council on April 17, 2002, for publication in the local newspaper on April 1 and
April 10, 2002, posted a notice on the property and sent notices to all property owners
within 300 feet of the above mentioned property.
5. On April 17, 2002, Tom Sainsbury representing Randy Bird, appeared before the City
Council for the City of Rexburg requesting a zone change from High Density Residential
(HDR) to High Density Residential 2 (HDR2) on property located at 455 So. 2"d East.
There was no opposition expressed concerning this zone change. It was moved and
approved that the Council following the recommendation of the Planning & Zoning
Commission and granted the requested zone change to HDR2.
