Dear Kurt:
Please accept forma! submittal of the Applebee's restaurant site pian set for review and
approval. REGI Really, LLC is under contract to purchase a 1 . 11 4 -acre site from Floyd Wilcox &
Sons, Inc. at 975 University in Rexburg-. The seller will create the lot for development
concurrent with the development approval process.
The Applebee's building is 6,138 square feet, which includes the main restaurant area of 4199

square test, 24 square feet for beer & wine storage, 404 square feet for res#rooms and a 714
square -foot trash/service area.
The structure is predominately red brick with while accents and achalk-colored stone tower
with acovered entry feature, All rooftop equipment is dully screened by parapetand the
trash/service area is screened by a twelve foot high wall extension of the building. Striped

awnings further enhance the windows and "to go" door. Landscaping exceeds the City code
requirements to present an aestheticaliy pleasin9 development at this gateway to the'
Access to the site is off a P"rivate drive shared with Arriericinn, which intersects with Golden
Beauty Drive east of the site. A shared drive will also be constructed along the ,east property
line for joins use with the undeveloped site east of the Applebee's lot: There will be' no direct
access to the site from Highway 20 off -ramp or University.

RCI Realty, LLC is under contract to purchase a parcel of property located at the northeast
corner of the Highway 20 off�ramp and University Boulevard in Rexburg, i D. The current
property owner and seller is Floyd Wilcox & Sons, Inc. The seller will create the 1.1 14 -acre
parcel dor development of a 6,138 square -foot Applebee's restaurant. The site plan and
architecture is in substantial compliance with the City of Rexburg Development Code
Commercial Design Standards for structures less than 25,000 square feet as demonstrated
below.
Facades and Exterior'Walls

The Applebee's restaurant is a 6,138 square foot 'building, which ineluds a 714 squire foot
service/trash enclosed area. The prototypical design incorporates a variety of architectural
features, building materials and calor to provide visual interest ani human scale. the
presentation is inviting and will compiiment the character of the immediate area and
hosa„Americ ipuse of the lmrnediately adjacent to the site. The proposed development
is consistent with the community's identity, character and scale.

and the "to go" doer. The north elevation is further articulated by a covered service/trash
enclosure area that is setback from the main building footprint approximately fifteen fees.
Therefore, over 60% of the linear budding public street frontages are articulated. In addition to
the entry feature, windows and awning treatments, these elements are further articulated by a
change of facade mafierial (brick end s#ane), roof elements and colar.
Smaller Commercial Stores
INTENT: the presence of smaller commercial stores gioves a fridfier appearance by
creating variety, breaking upbarge expanses, and exp�rrding the range of the site's
activities. Windows and window displays of such sores should be used to contribute
to the visual interest of exterior facades, The standards presented in this section are
directed toward those situations where additlonal, smaller stores, with separate,
exterior customer entrances are located in the principai b ildings or development site.
This design standard does not apply to the Applebee's development. This will be a stand-
alone building which is not a ,dart of a larges commercial development.
STANDARD: Where principal buildings contain addrtivnal separately owned sores,
which occupy less than 25,000 square feet of gross floorarea, with separate, exterior
customer entrances.
The standard described does not apply to the proposed free-standing Applebee's restaurant.

The building facades include repeating patterns of color change, texture change and material
module change. The color changes repeat both horizontally and vertically. The base building
color is red brick, which alternates with a horizontal color change of a light brick accent band
and window sills, then red back with light stucco cornice capping

The site is designed to evenly distribute the parking areas and therefore minimize their visual
impact. Landscaping 'is provided around the perimeter of the sHe except for the access drive
on the past. Snow storage meas are defined on the site plan which meets the Rexburg cods
requirement_
Back and Sides
INTENT: The rear or sides of buildings offers present an unattractive view of blank
walls, loading arias, storage areas, HVAC unifs, garbage receptacles, and other such
features. Archl'tectural and landscaping features should mitiga�`e these impacts. Any
back or side- of a building visible from a public orprivate righ��af-way s%al! be built in
accorda-nce with Article 1, The Planning CO mission may waive this requirement as
part of an agreed upon development flan.
Applebee's uniquely screens all trash and service areas with a 12' high continuation of the
building wail. This is in the same brick facade treatmen� as tie rest of the restaurant with
cornice treatment. This area is. totally enclosed and roofed to filly screen it from view from
public and private streets. The metal trash enclosure doors provide access to the waste
collection services and are painted to match the building. Landscape ares surround and
fiF-ame the building. All rooftop mechanical equipment is located behind the parapet walls and
therefore fully screened.

Outdoor Storage, Trash Collection,, and Loadin
INTENT: Loading areas and outdoar storage areas exert visual and noise impacts on
surrounding ne�9ghbarhovds. These aromas, when visible from ad, joininc� properties
artdlar public sires#s, shoulaf be screened, recessed or enclosed. While screens and
recesses can effectively mitigate these impacts, the selections of inappropriate

screenr`ng ma#eria/s can exacerbate the problems. Appropriate locations for leading
and outdoor storage areas include arias .between buildings, where more than one
building is located on a site and such buildings are not more than forty Feet apart, or on
those sides of buildings that do not have customer entrances.
The trash/service enclosed area and unloading area are on the apposife side of the building
from the main customer entrance. As described above, the servicelrash enclosure is dully
enclosed with a `I2' high wall extension of the building, covered by a roof. The activities of this
area will not be visible from adjoining properties or public streets.
STANDARD:

The Applebee's design meets and exceeds this standard as described above.

permanently defined and screened with wail fences. Materials, colors
and designs of screening wails andlor fences and the cover shah conform to
those used as predominant materials and colors of the building. If such areas
are to be covered, then the covering shall cnform to those used as ,predominant
materials and colors on the buildings.

Thank you for providing the sidewalk sketch. The pians have been modified per
your January 22 email response and phone conversation. Although the
applrcant still has reservation over interference to traffic circulation during
construction, he has agreed to construct the concrete crosswalk across the
private shared drive between Lot 6 and the Amerid n site per your request. The
pedestrian connection now crosses the shared drive between Lot 6A and Lot 6,
then crosses south across the shared drive. Accessible ramps and detectable
warning panels will be added to the sidewalks north and south of the crosswalk.

Dear Gary:
On January 3, 2007, we received Staff's Building Permit Submission Review comments
regarding the application submitted for the Applebee's Restaurant at 975 University
Blvd. Since January 3rd we have had several telephone conversations wath City staff to
discuss these comments. This letter provides written response to the comments and
requests a cursory check by the Design Review Committee prior to campletion and
submittal of the final revised site ;plan and complete construction set. Thank y�au for
your offer for a quick response from the City in order to maintain our building schedule.
As we discus -sod earlier this week, we understood that our Site Plan application
submitted can 7/706 was approved with revisions addressing the remaining few planning
comments submitted an 11/17/06 along with the Building Permit Application. Based
upon those earlier discussions with City staff, we were given some assurance that we
could anticipate a building permit late December and therefore scheduled a
construction start the first week of February, 2a07. Anything you can suggest to
salvage thi's construction schedule will be greatly appreciated. We understand your
dilemma coming into this project mid -stream presents its challenges and we appreciate
your effort Whelp us get the protect hack on track.

developments' , therefore the applicant/property ower is required to install
sidewalks from the subject property sidewalks network to the Golden Beauty
Drive sidewalk or an equivalent alternative.
