During those discussions it was represented to us that the City's plan was to talo 5D' sof rand from both sides of the section line in oder to accommodate the 100' right-of-way required for a minor arterial street. We had several concerns about this pian. However, in e end we agreed to deed the 5Q` to the city for the forger street with the understanding that the power fines would eventually be moved and the street widened on both sides of the section line. It has recently come to our attention that the City has re-evaluated that pian due to the cyst of moving the power poles. It is now sur understanding that the curb and gutter of the minor arteria( will be placed as close as passible to the existing power line. Because of this there will be a very wide strip of fond between the southern curb of 7" North and our development that will be totally unused. We are 'very concerned that this strip of land will become a weed patch and will not only be an eye -sore, but will also be expensive for the City to maintain. We would propose that the City deed back to E3C Stonebridge half X25'} of the 5D' strip of land that was originally given up for the widening of 7 t" [forth. This would lease approximately 15'of space behind the south curb for a park strip, sidewalk and perhaps a bicycle path. We will then place the separation wall on the new property line. This will insure that 7 t North will have auniform look once it is improved and will eliminate the problem of having a large strip of land that is not utilized and is simply a maintenance problem for the City. As you may know, we are planning to place a very nice concrete separation wall on the property line between 7th North and our development, (I have included a brochure in this package on this separation wall). UVB were prepared to start construction on this waft two weeks ago. However, when we (earned of the new pans for 7 #h North we have postponed construction due to our concerns mentioned above. We would respectfully request that the City review this matter and inform us as to the resolution as quickly as possible so that we can continue with the cvnstructFon, Sincerely, Pt actings in _ �p-m nt■ Inc. We would ask that You proceed with that action at your earliest convenience. Fax-, (801) 294-0497 August 15, 2006 Rexburg City 21 North Center Street Rexburg, ID 83440 ATTN: Mayor Shawn Larsen Jahn Millar City Council Members Mr. Mayor, Jahn and City council Members; Many of you may be aware of the problems that have arisen concerning the street right of way on 7 t North adjacent to the Stonebridge Subdivision. For those who are not familiar with these issues I offer a brief history: During the planning and approval stage of the Stonebridge Subdivision on 7 t"' North, we had lengthy discussions with the City about the flan to make 7 t North a minor arterial street. During Mase discussions it was represented to us that the City's pian was to take 50' of hand from both sides of the section ling in order to accommodate the 100' right-of-way required for a minor arterial strut. We had several concerns about this play and voiced our opinion that it ready wasn't feasible due to the existing overhead power poles and location of existing homes on the south side of 7th North. We also felt that it was an unfair burden on Stonebridge to require the abandonment of approximately 1,5 acres of land for a planned road widening that would serve the general public. However, because we were told our plat would not be approved otherwise, we agreed to deed the 5D' to the city (with no compensation) for the larger street with the understanding that the power lines would eventually be moved and the street would be widened on both sides of the section line. A few months after recording our plat. for Phase 1 of the subdivision it came to our attention that the City had re-evaluated their position. Be -cause of the costinvolved in moving the existing power poles, and other issues, if was our understanding that the City had derided to heave the power pokes and amend their flan for the widening accordingly. We, were quite frustrated to learn of this development and immediately wrote a letter to John Millar and the City Planning Department dated August 7, 2002. see attached In this leiter we proposed that the City deed back to us 25' of the 5C3' to avoid a large no -mans land that would eventually fill with weeds and garbage. In late September of X002 we finally received a response from then Mayor Bruce Sutherland proposing that the City deed back 2D' of the 50'. it is my recollection that this response camp by way of a telephone calf to our office_ We immediately responded in writing, agreeing to this proposal, and requesting that the City prepare the necessary paperwork, (see attached letter dated September 27, 2002) Feeling that the matter was finally put to rest, we proceeded with the development and placed our concrete waft based on the commitment of the city to died back 20'of land. Unfortunately, bath parties failed to follow up on this issue and 1 now understand that the 5(}' was never actually deeded to the City and the 20' was never deeded back to E3C Stonebridge. In order to resolve this issue, BC Stonebridge Properties, LLC will proceed immediately in preparing a legal description and deed to transfer ownership of a 3Q' strip of land along the entire frontage of the Stonebridge Subdivision. We would ask that the City respond in writing with their approvel of this plan and an acknowledgement that it fulfills the requirements of the agreements made previously between BC Stonebridge Properties., SLG and the City of Rexburg, Sincerely, Brett W.
