Subject: ADA Toilet Locations at Rexburg Idaho Temple
Dear John,
I am in possession of an inspection ticket dated 6/19/07 regarding the incorrect
location of many of the ADA toilets in the temple. Per the referenced standard each toilet
base should be within 16 to 18 -inches of an adjacent wall. As I understand it, many of the
toilets are within an 1" of this requirement with the remaining couple within 1 Ys".
Jacobsen has forwarded this correction notice to Mountain West Mechanical and
they have responded with the attached fetter. While I am aware that you have granted
limited latitude to Sam on this issue, I am hopeful we can receive a little more as repairing
this issue in rooms with completed finishes will cost thousands of dollars.

Dear Chad:
In addressing the issue of the ADA water closet locations, we have the following comments and
concerns.
After obtaining the ICCIANS I Al 17.1-2003 regulations and upon reviewing them, I noted that under
Chapter 2, Scoping 203 Administration it states, "The administrative authority shall provide an
appropriate review and approval process to ensure compliance with this standard."
We note that according to the recorded documents signed by the administrative authority that
numerous inspections were perfbnned and signatures were obtained verifying acceptability of the
installed rough -in of the piping, whiob included locations of the water closet flanges and at no time
were we informed or received any comments that we were out of compliance.
It is and always has been our intent to comply with the codes and regulations regarding the installation
of plumbing systems. However, we were unaware of the ANSI compliance requircment as indicated.
In fact; we have always been under the impression that the 18" dimension was a muvmwn with an
allowance up to 20", Most architectural drawings indicate an 18" dimension without specifics of
minimums ormaxunums.
As I have reviewed the ANSI 604.2, I note that while the code indicates a 16"-18" dimension it also
gives a IT'-19" dimension for ambulatory facilities. This indicates to me some allowance for these
dimensions, while obviously these dimensions are specified for purposes of providing a certain

comfort level for the handicapped person it seems as though there is some element of allowance in the
dimensions.
Furthermore, as I reviewed the purpose of the ANSI StwWard I noted that under dimension
definitions it states "all dimensions are subject to conventional industry tolerances." I have been
unable to establish what the "industry tolerances" are, so I suppose that it is left up to the
administrative authority to establish that.
As I further reviewed the ANSI spec, it says, "Nothing in this standard is intended to prevent the use
of designs, products, or technologies as alternatives to those prescn'bed by this standard, provided the
result is equivalent or Meeter accessibility and such equivaleecy is Woved by the administrative
authority adopting this standard.
As far as I cah tell, the dimensions established with the hough -in would meet the "equivalent or
greatesr" standard. As indicated in the purpose "the intent of these sections is to allow a person with a
physical disability to independently get to, enter, and use a site, facility, building or element."
Finally, as we, aze aware that in several cases we are out of compliance with the IV-1 8"' dimension,
because of the state of completion that the building is in, it would be very costly to go back and
modify the water closet flanges to bring them in to compliance. We believe as indicated that we are
within allowable tolerances and that the comfort level of the person will not be compromised. We
therefore respectfully request that the established rough -ins be allowed and that we may trove forward
with the installations of the water closets.

Question:
There has been some discussion about the possibility of replacing the gate at the Main Level on the South Stair
with a barrier that is concealed in the wall. Please advise us how to proceed.

Response:
In correlation with Vern Martindale, Chad and others it is agreed to delete the metal gates at the
main level and provide a drop down barrier with a magnetic door hold open and a hydraulic cylinder similar
to the one at the Nauvoo Temple. Provide and install a drop down barrier similar to the one shown in
attached photos. The hinge is to be made from stainless steel or aluminum channels or bend plate. Provide
and install a magnetic door hold open (Honeywell Door Holder Number S4003A & B) tied into the fire
alarm so that when released the armlbarrier will drop. The hydraulic cylinder is to be SUDA CI6-08-568,
Grand Rapids, Michigan or equal. The Barrier is to extend across the width of the stairs. Recess in framed
wall. Extend wall finish over the face of the barrier so that it is hidden in wall.
